MINUTES of the Lexington Zoning Board of Appeals August 10, 2006 <br /> Present: Chairman — Judith J. Uhrig, Nyles Barnert, John McWeeney, Arthur Smith and <br /> Associate Leo McSweeney <br /> Petition Address: 12 Theresa Avenue <br /> The relief sought is for a Special Permit from Section 135 -32 to allow replacement of a shed <br /> within setback requirements. <br /> The Chairman opened the hearing at 7:45 PM by reading the legal notice and described <br /> information received from the petitioner relative to the petition. <br /> Prior to the hearing, the petition and supporting data were reviewed by the Building <br /> Commissioner, Conservation Administrator, Town Engineer, Health Director, Zoning <br /> Enforcement Officer, Planning Board and Development Review Team. No Comments were <br /> received. <br /> Frederick Stubbs and Kathy Solomon, owners of the property, presented the petition explaining <br /> the existing 8 x 10 shed is deteriorating and they would like to replace it in the same spot which <br /> is within the set back requirements. <br /> The Board questioned if the neighbors had been told about the shed replacement and if there <br /> were any comments. <br /> There were no questions from the audience. <br /> No one spoke in favor or in opposition of the petition. <br /> Hearing was closed at 7:49 <br /> On a motion by Arthur Smith and seconded by Leo McSweeney the board voted 5 -0 to grant the <br /> VARIANCE to allow the replacement of the 8 x 10 shed in the same spot. <br />
