Home My WebLink About2011-06-07 CONCOM-min MINUTES – LEXINGTON CONSERVATION COMMMISSION June 7, 2011 Commissioners present: Joyce Miller, Stew Kennedy, David Langseth, Dick Wolk, Charlie Wyman (7:34 pm) Commissioners Absent: Phil Hamilton, Duke Bitsko Others present: Karen Mullins, Conservation Administrator; Louise Vinci, Conservation Clerk Chair Joyce Miller opened the meeting at 7:30 pm in Room G-15, Town Office Building 7:30 pm Informal: Paint Mine Run Josh Katzman came before the Commission requesting permission to use the Paint Mine Conservation Area for a running event consisting of 10K, ½ marathon, full marathon, and 50K runs. The Commission would like the following conditions followed as terms of approval:  Participants use the entrance off Grove Street, not the entrance on Robinson Road.  Take photos before and after event at Hennessy Field to monitor impact.  Take measures to ensure runners safety across Turning Mill Road.  Notify public about race. Motion made and seconded to approve, 5-0 in favor 7:42 pm Cont. Hearing: NOI, Minuteman Bikeway, DEP# 201-818, BL 776 Present for the applicant: David Canon, Engineering Department Michael Carter, GCG Associates Documentation: e-mail from Duke Bitsko, dated June 7, 2011 “Soil evaluation at four locations along the Bike Path – Revere Street, Lexington”, dated June 3, 2011 Michael Carter submitted soils evaluation with photos and went over findings of intermittent stream channels. Comments from the Commission follow: David Langseth supported findings of intermittent stream channel and requested a design detail consisting of more than placed rip-rap. Joyce Miller read Duke Bitsko’s comments into record. Mr. Carter explained that he needed the approval of the stream intermittent status in order to proceed with design. Hearing: 142 Marrett Road, DET# 11-12 Documentation: Request to continue hearing, dated June 7, 2011 Motion made and seconded to continue hearing to June 21, 2011 at the applicant’s request, 5-0 in favor. 7:54 pm 129 East Emerson Road, DET# 11-15, Map 62, Lot 133 Present for the applicant: Larry Cohan, Archadeck of Suburban Boston Deborah Zuckerman, applicant Documentation: Request for Determination of Applicability with attachments Public notice Larry Cohan described proposed project which consisted of removing existing deck and replacing it with smaller covered porch. Comment from the Commission follow: David Langseth would like an orange work fence along limit of work boundary. The Commission would like it noted for the record that the patio where the spa is to be removed that is depicted in application is not being proposed at this time. Motion made and seconded to issue a negative determination with conditions, 5-0 in favor. 8:02 pm Hearing: NOI, 65 Munroe Road, DEP# 201-823, BL 781, Map 25, Lot 84A Present for the applicant: Fredrick Russell, Engineer Documentation: Notice of Intent with attachments Wetlands Delineation Report, dated June 5, 2011 Revised Site Plan, dated June 4, 2011 Town Engineering Department comments Public Notice Public Notice and Town Engineering comments were read into record. Fred Russell presented a project to raze and rebuild a single-family dwelling outside of the 100 foot buffer to bordering vegetated wetland with proposed infiltration within 100 foot buffer. Motion made and seconded to continue hearing to July 12, 2011 at the applicant’s request, 5-0 in favor. 8:26 pm Hearing: NOI, 38 Adams Street, DEP# 201-819, BL 777, Map 38, Lot 106 Present for the applicant: Michael Juliano, Engineer Documentation: The Commission discussed the replication area and if wetland replication was permissible within a Conservation Restricted Area. Administrator Mullins confirmed that plans requested by the Commission had been submitted. Motion made and seconded to close hearing, 4-0 in favor. Charlie Wyman did not vote as he did not participate at all meetings. 8:30 pm Cont. Hearing: 29 Pearl Street, DEP# 201-820, BL 778; Map 29, Lot 31A Documentation: Request to continue hearing, dated June 7, 2011 Motion made and seconded to continue hearing to June 21, 2011 at the applicant’s request, 5-0 in favor. 8:31 pm Informal: 24 Valleyfield Street, Richard Kirby came before the Commission looking for guidance in the replacement of a deck with a sunroom. He questioned if an area would be considered a wetland under current regulations. The Commission and Administrator Mullins discussed the regulations and felt that the area in question was a regulated wetland and the applicant should file an Abbreviated Notice of Resource Area Delineation or a Notice of Intent before proceeding with the proposed construction. 8:42 pm Informal: Ragweed Study, The Commission discussed a request by the University of Massachusetts School of Public Health to collect and study samples of ragweed growing in Willard’s Woods during the summers of 2011-2013. Motion made and seconded to approve request, 5-0 in favor. 8:45 pm Hearing: NOI, 17 Bryant Road, Present for the applicant: Brian Timm, Meridian Associates Adam Cristy, Meridian Associates Richard Kirby, LEC Environmental Page 3 of 4 MINUTES – LEXINGTON CONSERVATION COMMMISSION MEETING June 7, 2011 Joe Gelormini, applicant Documentation: Notice of Intent with attachments Richard Kirby presented a plan to raze and rebuild a single-family dwelling. Comments from the Commission follow: Stew Kennedy noted that no landscaping plan was provided for the twenty-five foot buffer. Richard Kirby explained that no work was proposed for the twenty-five foot buffer and the stone wall would be used as the limit of work. The Commission would like bounds placed along the eastern twenty-five foot buffer to bordering vegetated wetlands. Motion made and seconded to close the hearing, 5-0 in favor. 9:10 pm Accept Conservation Restriction, 2 acre parcel to rear of 38 Adams Street, Motion made and seconded to accept Conservation Restriction, 5-0 in favor. 9:11 pm Re-open Hearing: 359 Lincoln Street, DEP# 201-504, BL 462, Map 42, Lot 221 Documentation: Request to continue hearing, dated June 7, 2011 Motion made and seconded to continue hearing to June 21, 2011 at the applicant’s request, 5-0 in favor.
