Lexington Board of Health Meeting, July 14, 2010 at 7:00 p.m. <br />Town Hall, Room 15 <br />1625 Massachusetts Avenue, Lexington, MA <br />Attendees: Wendy Heiger- Bernays, Chair; Burt Perlmutter; David S. Geller <br />Health Department Attendees: Gerard F. Cody, Health Director; Ann Belliveau, Health <br />Clerk <br />Heiger- Bernays called the meeting to order at 7 :00 p.m. <br />Community Health Report — The Board reviewed the Community Health Report and all <br />follow -ups had been done in a timely manner. <br />Environmental„ Health Report <br />Shade Street Noise Complaint — Information Presentation - Cody introduced <br />Richard Canale of 29 Shade Street to the Board. Canale distributed to the Board copies <br />of Mr. Canale addressed the Board of Health because he is concerned about noise <br />eminating from Shire. Canale stated he was representing himself but other residents on <br />Shade Street are concerned about the noise emanating from Shire. Nicole Ciccolo of 50 <br />Shade Street also advised the Board about the noise emanating from Shire even into her <br />backyard and the high pitch tonal noise wakes her up during the night. A discussion <br />followed. Canale also mentioned that a Shire consultant report had been submitted to the <br />Building Commissioner and the Building Commissioner will issue an RFP for a peer <br />review to determine whether to agree or disagree with the Shire consultant report. <br />Heiger- Bernays said the next step should be in touch with the Building Commissioner to <br />get the answers needed as to what measure is the appropriate measure in looking at the <br />noise bylaw. Heiger- Bernays said the Board needs to know what are the right metrics <br />and what is the interpretation and what will this facility and others be held to. <br />Environmental Health Report <br />Formosa Taipei — Maureen Lee introduced Brandon Lee representing Formosa Taipei. <br />Lee updated the Board as of 6125110. Lee stated some improvements have been made but <br />additional work is needed. As a result, the owner of Formosa Taipei has asked Lee to <br />stay on for an additional period of time. <br />RUYI — henry Cheng, Manager of RUYI appeared before the Board of Health to have <br />the Board approve the annual food permit and have the Board approve the HACCP Plan <br />for the production of sushi rice. After a discussion, Heiger- Bernays motioned that the <br />Lexington Board of Health has agreed to issue a food permit to operate RUYI at 27 <br />Waltham Street. It is anticipated that compliance will be achieved with the Food Code. <br />Be aware that failure to comply with the food code may result in certain corrective <br />actions including but not limited to you hiring a food consultant to provide your staff <br />with training or closure of your establishment due to serious and repeated violations of <br />the Food Code. Perlmutter seconded. All approved. <br />Perlmutter motioned that the Lexington Board of Health grants the variance as outlined in <br />Food Code 3- 502.1 for the acidification of rice intended to prepare sushi products. RUYI <br />is required to follow the plan as submitted to this office, including but not limited to, <br />maintaining accurate testing records for the rice, maintaining a calibrated pH testing <br />instrument and purchasing sushi grade products from approved sources. Failure to follow <br />
