Members Present (remote participation): Charles Lamb, Chair; David Kanter, Vice—Chair & Clerk; Sandy Beebee; Rod Cole, Wendy Manz, and Frank Smith Members Absent: None Others Present (remote participation): None Documents Presented: • Notice of Public Meeting/Agenda CEC Meeting, April 7, 2021 • Mr. Lucente, Chair, Lexington Select Board; E-Mail to the Lexington Town Meeting Members Association (LexTMMA) E-Mail List; April 6, 2021 10:19 A.M.; Subject: Reconsideration of Article 16g [Center Recreation Complex Bathrooms & Maintenance Building Renovation] • Draft Minutes of this Meeting, April 7, 2021 (presented at the end of the meeting) Call to Order Mr. Lamb called this Remote (Virtual) Meeting, which had been posted as such, to order at 7:00 P.M. As all those present had been previously advised of the special conditions of this meeting, he passed on repeating them (i.e., The requirement to have a physical presence of a quorum had been suspended in an Executive Order by Massachusetts Governor Charles D. Baker, on March 12, 2020, after having proclaimed, on March 10, 2020, a STATE OF EMERGENCY in the Commonwealth due to the outbreak of the 2019 novel coronavirus, known as "COVID-197). Mr. Lamb further reported that the documents for this meeting, which had been provided electronically to the Committee and would be available upon request, were those listed as Documents Presented. Any votes during this meeting would be taken by a roll call. This meeting is being recorded to assist in preparing Minutes, and the recording would be deleted once the Minutes were approved. Mr. Lamb took a roll-call vote and confirmed that six Committee members were remotely participating. Ratify Prior Positions Taken: It was Moved and Seconded that the Committee's unanimous position taken on April 6, 2021, to endorse an Errata #2 to the CEC Report to the 2021 Annual Town Meeting, be ratified. Roll-Call Vote: 6-0 Matters Related to the 2021 Annual Town Meeting (ATM)—Especially Those Related to the Session Immediately Following This Meeting Mr. Lamb raised that Mr. Lucente's e-mail reported: "The consensus was that the [Select] Board will move reconsideration, and recommend Indefinite Postponement of Article 16g. The Select Board will take a formal vote on Wednesday evening." Mr. Kanter reported he watched this evening's Select-Board Meeting, the Select Board did take that formal vote, and that process was unanimously supported. Mr. Kanter believes that they felt that the Project currently has an incomplete definition of a proposed scope of work, no rational for any selected scope (versus other options to be considered), and, therefore, Page 1 of 2 Minutes of the Lexington Capital Expenditures Committee (CEC) Meeting April 7, 2021 does not have an appropriate construction funding to be presented to a Town Meeting. There was hope those circumstances could be resolved, with the existing funding, in time for the Project to be presented to a Fall Special Town Meeting. The Committee then discussed those circumstances that had changed since its Report to this ATM which unanimously supported that Sub-Article. It was Moved and Seconded that the circumstances since this Committee's Report on the current ATM do warrant Reconsideration and a subsequent Indefinite Postponement—and that Committee position should be reported to the ATM Session at which the matter is presented. Roll-Call Vote: 6-0. Approval of Minutes/Report Mr. Kanter presented the Draft Minutes he had prepared during this meeting. It was Moved and Seconded that those Draft Minutes for this Meeting, including what will be the immediately-following time and vote to adjourn, be approved as presented with Mr. Kanter authorized to make non-significant changes.
