HomeMy WebLinkAbout1979-10-15u60 HEIDKE SUBDIVISION RIDGE ESTATE II BOARD OF HEALTH MEETING OCTOBER 15, 1979 The regular meeting of the Board of Health was held on Monday, October 15, 1979 at 7:00 P.M. in Room G-25 (Board of Health Office) of the Town Office Building. The minutes of the last meeting were approved as read. Mr. Smith introduced Mrs. Mary Smith to the Board as the new secretary to the Board of Health. Mr. Smith reported that it is time for the budget to be prepared. He said that there wouldn't be many changes except to add some money to the accounts because of inflation. Webb will been also Mr. Smith reported there will be a new subdivision off at Young St./ Sr. area. It will be a small subdivision and will be sewered so there be no problems there as far as the Board of Health goes. There has no review as yet from Engineering as far as drainage goes. It will have town water. The Ridge Estates II has been disapproved by the Planning Board so there is not a thing the Board of Health can do until new plans are submitted to the Planning Board. SMOSKE At 7:30 P.M. Mrs. Smoske came into the meeting ANIMAL PERMIT of Health. The abuttors to the Smoske property and HEARING were also invited to attend. as requested by the Board the owners of the 2 horses Those that attended were: Elizabeth and Larry Freier of 12 Demar Rd., Wade Rockwood of 14 Demar Rd., Bill Johnansen of 10 Demar Rd., Edward and Colleen Comerford of 53 Liberty Ave. (Colleen is the daughter whose horse is stabled at Smoske's), Julie Vohl of 27 Partridge Rd. (her horse is also stabled at Smoske's), also Mrs. Eleanor Comerford of 53 Liberty Ave., and Mary and Dan Brzezenski of 43 Robinson Rd. Mrs. Anne Vohl sent in a letter requesting that the Smoske's be able to keep their animal permit. Mrs. Vohl is the mother of one of the girls that stables her horse there. Dr. Cosgrove spoke first about the purpose of this meeting tonight to see if the Smoske permit should be revoked. Mr. Littleton, Animal Inspector, read his prepared statement regarding the Smoske's horses being loose frequently. Mrs. Smoske said these complaints were prior to the May Meeting. Mr. Littleton told her that we have had several complaints in October 1979 and two or three of them were within a week. He stated to her that her permit should have been revoked two years ago. Mrs. Smoske said one of the horses had been hobbled but it jumped the fence anyway. The horse is a jumper. Mr. Freier said the post of the fence is braced on his property and he also has pictures here tonight to show how the manure conditions are and also the damage the horse has done to his property. Mrs. Freier stated that the manure smell is overpowering. �_.61 -2- Mr. Johansen, abuttor, said he likes horses but not loose in his backyard. The manure is a problem, he stated, and he feels that the horses have not been taken care of properly. The horses should not be allowed to run free. The two horse owners want to put up a new electric fence but Barry Little- ton told them that the horse that jumps could jump over a six or seven foot fence. The Board asked why Mrs. Smoske did not tell the horse owner to remove the horse that was always getting out to remove the horse from her property. Mr. Comerford stated that he was going to sell the horse but his daughter was.heartbroken so he decided against it. Mr. Brsezenski spoke about the horse getting out and destroying his lawn and he wants the horse kept within the Smoske's property or the horse should be removed. Most abuttors talked about the danger to children with a horse roaming free in the yards and also about the danger to children if an electric fence was to be put up. Mrs. Smoske said the current fence was five feet high but Mr. Littleton said the current fence was only three fee high. Besides the neighbors complaining about the horse getting loose their other other complaint was the deplorable condition of the manure. Dr. Erdos said if all the abuttors agreed, with no exceptions, to go along with a new electric fence and if the manure was cleaned up frequently, perhaps we could try that but Mr. & Mrs. Freier objected. They felt they have been very patient long enough. The Board had stated at the last meeting with the Smoske's and the horse owner and abuttors that if complaints continued and if the horses kept getting out the permit would be revoked. After further discussion with Mr. Littleton again stating the permit should have been revoked two years ago the Board asked Mr. Smith, Health Director, his opinion. Mr. Smith felt the permit should be taken from the Smoske's. The Board voted unanimously to revoke the Smoske's animal permit. Dr. Erdos stated perhaps in the future perhaps guidelines could be provided and the Smoske's could re -apply. Dr. Cosgrove said in the future if the Smoske's could get together with the abuttors perhaps they could re -apply. The Board agreed to give Mrs. Smoske 45 days to remove the two horses from her premises. Dr. Cosgrove reported that he and Mr. Smith made a visit to the CMARC CMARC workshop. Dr. Cosgrove said he was impressed with what he saw and what they were doing for the people that are there. It is a 5 hour day:". and they are - 3 - training people to be able to move back into society. At the present time there are 5 Lexington residents there. Mr. Sewell told Dr. Cosgrove and Mr. Smith they were able to get along with the $5000.00 that the Town of Lexington voted to give them and they will not need to increase their request. PNEUMOCCOCAL Mr. Smith reported to the Board that the Pneumoccocal Vaccine Clinic VACCINE that the Board of Health ran was not really successful. We only had 37 CLINIC people attend. Mr. Smith reported that our Flu Vaccine Clinic is on October 25th and FLU VACCINE that the vaccine will be here from the State in time for the clinic. Dr. CLINIC Erdos suggested we should do more publicity for it. Mr. Smith reported that he had been over to Mrs. Winchells on Bowman WINCHELL Street today and they had dug down quite a way and found good gravel and SEPTIC SYSTEM that there was no ground water. The pit will be put in on October 16th or October 17th and that the system should last. Mr. Smith reported that the people from the Wood Park Estates were WOODPARK meeting with the Selectmen tonight. He said they seem to complain about ESTATES everything. They want the brook filled in - he said it has a good flow. The complain about the mosquitoes. He told them they were free to hire a pest control company. They complain about the rats. Mr. Smith had an exterminator out there twice and is getting prices from the. There are a half dozen gardens there with rotten vegetables left in them, there are compost heaps. Rats want food and these things provide food and harborage for them. HONEYWELL Mr. Smith reported that the Honeywell Company wants to put inground tanks TANKS FOR to store gasoline. 20,000 gallon tanks. Mr. Smith recommended that the GASOLINE City of Cambridge be notified, and also the office of the D.E.Q.E. The tanks have a limited life span. INSTALLER'S PERMIT There are no special laws right now and with gasoline companies there are no special regulations. Dr. Erdos said that the water supplies can get infected and they must be anchored down. It has been suggested to call Jack Conlin or Carl Eiden of the E.P.A. Mr. Smith told the Board that a young man came in to apply for an Installer's Permit. He has been doing work under John Brucchi's permit but John Brucchi has not had a permit for two years. He has no knowledge of Title 5 or any Rules or Regulations. Mr. Smith said if he could produce 3 permits from other towns he would consider it. Mr. Lambie asked how he can use Brucchi's permit. George said that he has been doing mostly drain laying work for Brucchi and he has that permit, mostly working on sewers. 1 1 1
