Meeting was adjourned at 9:15 p.m. BOARD OF HEALTH MEETING NOVEMBER 3, 1975 The regular meeting of the Board of Health was held November 3, 1975, at 7:00 p.m. in Room G-15 of the Town Office Building. Members present were Dr. William L. Cosgrive, Chairman; Mr. James W. Lambie, Dr. Charles E. Ellicott and. Mr. George A. Smith, Director of Public Health. The minutes of the October 14, 1975 meeting were approved with the following change: Mr. Lambie asked that the sentence "The Board said they would adopt any regulations or code to continue our enforcement program" be changed to read "The Board will consider any regulations from the State agencies before adopting new regulations. Mr. Smith reported that we had heard nothing from Mrs. Sharkey re- garding her animal permit. Mr. Littleton, Animal Control Officer, had SHARKEY been up and checked the area again. They have reduced the horses to four HORSE PERMIT and they have made some attempt at constructing a manure pit with a tarp over it. Mr. Smith went on to say that he had discussed this case with Mr. Cohen, Town Counsel, and he said the Board of Health would be within their rights to restrict Mrs. Sharkey to 4 horses and make any other restrictions they felt necessary on this permit regardless of the "Grand- father Clause". Dr. Cosgrove said he felt that 4 horses was a reasonable amount to allow Mrs. Sharkey to keep on the property she had. Mr. Smith said if the property is not maintained in accordance with the Health Regulations we could restrict this permit even more. If we do cut back the 6 horses to 4 horses it could mean going to court. Mr. Lambie asked if they had enough property for 4 horses and Mr. Smith said they could handle 4 horses very well on the amount of land available. Mr. Lambie and Dr. Ellicott said they would like to see things kept cleaner than they were at present. Dr. Cosgrove said all the junk cars were up to the Building Department. 1 1 1 569 The Board voted and duly passed that Mrs. Sharkey be granted a 6 months permit to keep 4 horses on her property at 13 Hazel Road. It was agreed that this permit would be tested on merit as we went along. Mr. Smith reported to the Board that 90 children were screened at the LEAD POISON Lead Poison Screening Clinic and four tests showed a blood level over 39. SCREENING These four children have been tested again but we do not have the results of the second screening. Mr. Smith said he would have liked to have done more but he felt that the screening was successful. Mr. Smith explained to the Board that he would like to require that all RETAIL retail food stores and markets be required to have a Retail Food Service STORES FOOD Permit. At the present time we only have these stores registered when they PERMIT are opened and this registration does not give us the control over the stores I feel we should have. Mr. Lambie asked what advantage would be gained in putting the stores under a Retail Food Establishment Permit. Mr. Smith said this type of permit would give the Board more effective control. The permit would then be renewable each year. He went on to say that most of the markets and food stores were getting into other things such as "Deli" foods and take out prepared foods which, with the present setup, we had no control over the operation. Mr. Smith went on to say he felt that these stores should have these permits to operate and there was a section in Article X which includes the operation of these stores. Dr. Ellicott said if we had so little jurisdiction over these stores now we certainly should get more and if the Food Service Permit would give it to us then by all means they should be issued. It was voted that all Retail Stores and Markets would now be required to file for a Food Establishment Permit, this permit renewable yearly. Mr. Smith announced to the Board that he was planning a Food Handlers FOOD HANDLERS Course in January or February. Attendance can be made almost mandatory. COURSE He will be able to have people from the State Health Department. The course will consist of slides, lectures and hand outs. He went on to say that he plans to have these courses during the day, they will offer the course to a group for 3 hours in the morning and then repeat the course again in the afternoon. This will enable all restaurant personnel, school lunch personnel, nursing home personnel and industrial kitchen and cafe- teria personnel to attend. Mr. Smith explained to the Board that there were some changes in the con- tract figures that was sent by Westbom Associates. The Board suggested that LEAD PAINT these figures be tabled until copies of the changes could be sent to the Board members. Mr. Smith explained that Rosina's Kitchen at 363A Massachusetts Ave. ROSINA'S had submitted plans for the addition of tables and chairs to their present KITCHEN operation. He explained that he had sent the owners of the restaurant that they must do certain things before this plan could be approved. The most important thing is the installation of a dishwasher. The owners must use paper service until a dishwasher is installed. Mr. Smith explained that another "Deli" was being installed at 137 DELI GLORIA FOODS 570 Massachusetts Avenue. It will be called Gloria Foods. They will probably be opening as soon as they install another toilet room and a final inspection is made. FAIRLAWN Fairlawn Nursing Home has submitted plans for the renovation of the NURSING HOME kitchen. Mr. Smith said he thought this would be a good improvement to their operation. Mr. Smith explained that a number of people have been interested in BREWSTER'S opening up another Food Establishment at Brewster's which is owned by McManus Ice Cream Corp. He went on to explain that he has told anyone coming into the office asking about this property that unless the building is connected to the public sewer, which is available, he will not approve any operation suggested. A letter has been sent to the McManus Corp. to this effect. COLONIAL Mr. Smith reported that he had a complaint of wormy candy purchased PHARMACY at Colonial Pharmacy. The first complaint was made last month and at that time an inspection was made and about 40 pounds of candy destroyed. Today another complaint was received and more wormy candy found. Mr. Smith said he has contacted the State Department, Food & Drug, to help with this. What he must do is locate the distributor of the candy. Dr. Yudowitz of Wild Acre Inn, had been scheduled to appear before the Board at 7:30 p.m. Dr. Yudowitz did not appear and therefore Mr. Smith WILD ACRE explained to the Board that the Selectmen are still waiting to issue a INN lodging house permit. Dr. Yudowitz has done a lot of work of cleaning, repairing and painting. Right now he is still pumping the septic tank about every two weeks. He still has not applied to have this dwelling connected to the public sewer which is something he should have done. Mr. Smith went on to explain that Dr. Yudowitz had appeared before the Board of Selectmen and assured them he was running a lodging house and not a "Half -way House". We have a copy of a letter from Dr. Yudowitz to the Selectmen assuring them of this. Mary Live of the State Mental Health De- partment did come out to inspect the place but when Dr. Yudowitz was not there she did not inspect the place. We have sent her a letter stating this is to be lodging house, this is a copy of the letter from Yudowitz to the Selectmen. Mary Love said she would notify the MacLean Hospital of the status of this place so they would not send patients there. Dr. Ellicott said he was concerned because of the report of the Visiting Nurse about patients or tenants exchanging various prescription drugs. Mr. Smith said that at the present time we must judge the establishment as a lodging house. Mr. Chase, Town Engineer, who attended this meeting was asked how much he estimated it would cost to connect this property to public sewer. Mr. Chase said if he went down in the back of the land to Highland Avenue it would probably cost about twenty thousand dollars, this would enable him to put in a gravity feed system. He could probably service his own building with an ejector pot for about ten thousand dollars. Dr. Yudowitz has been told he must petition the Selectmen for this system and to date he has not got in touch with anyone about the work. Dr. Yudo- witz does have his own engineer who has been working on this. The Board after some discussion with Mr. Chase suggested a letter be 1 1 1
