who knows how to read continuing to take this milk.
Mr. ';Jest: I can't say a thine to anybody. We are helpless
to straighten this thing out. I feel we should have a lawyer who
could devote more time to this case. Sit right on it, so to
speak. I do know that if one person or child gets sick during
this time from this milk, I will blow this place wide open.
Mr. Legro continued his discussion of sampling, and the
procedures of sampling according to the Milk Regulation Board.
He also suggested if the"Fi ndi nes" were upheld, our local Milk
Regulations should pe changed and approved by the Milk Re ni tions
Board. He again stated that all our records had ;Peon reed into
the State Public HAalth Council Haring, and the Judge should
have toose statements.

T -,e regular meetinc of the Board of HFalth was held in the
Health Department Office, March 14, 1966 at J:0c» P.M. Members

Minutes of the February %, 1966 meeting were approved as read.
Mr. McQuillan and Mr. Finneran reported on a meeting they had
with Mr. Edward Martin, Assis*ant Attorney General, recording the
B. L. Cummings, Inc., case.
Mr. West said he thought a letter to Mr. Cole, Chairman of
the Board of Selectmen, should be written stating the facts once
again of the B. L. Cummings Case. T'Liis letter would probably not
receive any action, but at least it would be on recod that we had
written to the 3oard of Selectmen.
Mr. Ma uillan said that rather thin a letter to the Board of
Selectmen_he would like to have the Board's approval to report the

facts of the 3. L. Cummings' Case from the floor of the Town CUMMINGS
Meeting, March 21, in accordance With Article 2 of the Town CASE
Warrant which states all reports of Boards, Departments and C CONT.
Committees will be accepted at this time. This will not be a
vindictive report, just a continuation of the statement of facts
sent to all Town Meeting Members, and he would like to close
this report with the recommendation by the Board of H<alth that
a study be made regarding the advisability of setting up a full
time legal department for the Town of Lr,xington so that any
Board, Department, or Committee could request and receive legal
advice as it was needed.
Mr. ;lest made the motion that a statement of tact oe given
from the floor of the Town Meting March 21 in accordance with
Article 2 regarding the 3. L. Cummings' Case, and a recommendation
of a study for a legal department bemade, if Mr. Kent, Town
Moderator, said this was the correct procedure to follow. Motion
seconded and duly carried.
Mr. McQuillan reported that Mr. Finneran had showed him in
the Massachusetts General Laws where a Board of Health cannot
appoint an advisory council of doctors. He wondered haw the
3oard felt if a letter was written to Dr. Ellicott stating the
position the Board is in, and suggest that if he and other
medical men were interested in forming their own advisory council
the Board would be very pleased to have them work with us on our,
health program.

Motion was made and seconded that Mr. R. L. Mcfuillan L.V.N.iv.Rep-

The request by Roger Swenson, 16 Fairlawn Lane to keep ANIML PERMIT
20 chickens for a period of 45_ to 5 months in order to meet
the requirements for his son to earn a_Boy Scout Merit Badge
in Poultry was discussed by the Board. Mr. Finneran reported
that all the abuttors had been contacted, and no objections
were made, but due to the residentail character of the neigh-
borhood he would recommend that a Temporary Permit for five
months (April 1 to August 31) oe issued. The Board voted to
issue c temporary permit For a 5 month period to Mr. Roger
Swenson for 20 chickens.

The Board checked the Health Officer's report, and in-
structed 1r. Finneran to write letters to the companies with
high milk counts.
Mr. Finneran explained that he had talked with t. u

that the driver leave no more than one carton of mi 1k during the
winter months, and at the most two cartons during the sorinq and
fall months.
As there was no further business to discuss, the meeting
was adjourned at :15 P.M.
