The letter to Concord Dairy and Brox's Dairies regarding MILK COUNTS
the high bacteria and coliform counts on the last milk analysis
report was approved by the Board.
The animal permit application for permission by Laurence ANIMAL
Larrssen to keep 1 pony at 269 Wood Street was discussed by PERMIT
the Board. Mr. Finneran reported that there was sufficient
area for a stable and corrall. Permission was granted pro-
viding the area be kept clean and the waste removed weekly.
Also that the stable and corral be located not less than 150
feet from any of the abuttors. Mr. Finneran informed Mr
:arrssen of these conditions.
The license for a Food Establishment, Village Variety, 93
Massachusetts Avenue and the Montassari Child Care Center license
130 Pleasant Street was signed by the Board.
The Health Officer's report was checked and the Board in-
structed Mr. Finneran to notify Blue Ribbon Dairy and Musgrave's
Farm of the high bacteria and coliform count obtained from the
milk analysis of October 15, 1965, they also instructed Mr. Fin-
neran to collect additional samples of Blue Ribbon Dairy Milk
from the schools.
No further business was discussed and the meeting was a
journed at 8:30 P.M.

BOARD OF HEALTH MEETING
DECEMBER 6, 1965
The regular meeting of the Board of Health was held on Monday,
December 6, 1965 at 7:00 P.M. in the Health Department Office.
Members present were R.L. McQuillan, Chairman, Dr. William Cosgrove,
Mr. James M. West and Director of Public Health, James F. Finneran.
Minutes of the November 1, 1965, meeting were approved as
read.
Mr. West said he would like to record in the permanent records
that the Statement of Fact: Re: B.L. Cummings Case which was
sent to all Town Meeting Members was undated but that this Statement
was prepared and mailed November 15, 1965.
The Board discussed at great length the meeting with the B.L. CUMM-
Executive Board of the Town Meeting Members Association, sched- INGS
uled for Thursday evening, December 9, 1965, regarding the
problems facing the Board of Health at this time. Following this

discussion a motion was made and dully passed that the Board of
Health would request the assistance of the Town Meeting Members
in obtaining legal counsel in order to bring to a conclusion the
case of B.L. Cummings. The Board also requested that Mr. Finn-
eran draw -up an Article to be placed on the Town Warrent asking
for special legal counsel to bring this particular case of B.L.
Cummings to a conclusion.

The Board instructed Mr. Finneran to bring all correspondence
regarding this case now on file in the Health Department to the
metting on Thursday evening.
Mr. Finneran reported that he had inspected Carroll's
Piggery, and they still had some pigs, not many, but our
order stated all pigs must be gone by November 30, 1965
therefore, a complaint should be filed in Concord District
Court. Motion made and seconded that a complaint aga'i'nst
Carroll"s Piggery for the removal of all pigs should be made
in District Court.
3 & 6 FAIR- Mr. Finneran also reported that complaints should be filed
BANKS AVE. against the owners of number 3 and number 6 Fairbanks Avenue,.
both owners have been ordered to connect to the public sewer
in order to abate the nuisance of over -flowing sewage. Neither
owner has made any attempt to abate this nuisance or contact
Public Works Department for public sewer connection.
Motion was made and dully passed that a complaint be filed
against the owners of houses numbered 3 and 6 Fairbanks Road
demanding that they connect these houses to public sewer in order
that the nuisance of overflowing sewage be abated.
MYSTIC VALLEY Mr. Finneran reported that an Article request for the
MENTAL HEAL Mystic Valley Mental Health, Children's Clinic had been
TH submitted to the Selectmen's Office.
MILK ANALYSIS The letters to Musgrave Farm and Blue Ribbon Dairy
REPORT regarding the high bacteria counts found in the milk
analysis was approved by the Board.
TUBERCULOSIS Notice of an increase in the per deim rate for hospital
PER DEIM RATE tuberculosis patients was placed on file by the Board.
MEASLE VACCI- The notice that Measle Vaccine was available from the
NE State Health Department was discussed. Mr. Finneran explained
that the vaccine is available for children 9 months to 5 years
of age who have not had measles and only where there is a
need. It was also suggested that this vaccine be distributed
through well baby clinics, or hospital clinics and as there
are no clinics of this type in Lexington Mr. Finneran said he
thought a letter to the Doctors stating the stipulations of
