62 <br />BOARD OF HEALTH MEETING <br />MARCH 16, 1965 <br />The regular meeting of the Board of Health was held <br />Tuesday, March 16, 1965 at 7:00 P.M. in the Health Depart- <br />ment Office. Members present were R. L. McQuillan, Chair- <br />man, Mr. James M. West and Director of Public Health, James <br />F. Finneran. <br />Minutes of the February $, 1965 meeting were approved <br />as read. <br />MILK COUNTS The letters to Brox's Dairy, Concord Dairy and Cumberland <br />Farm Dairy calling their attention to the high bacterial counts <br />and Coliform Counts obtained from the laboratory analysis of <br />milk January 14, 1965 was approved. <br />Mr. Finneran reported that replies were received from <br />Brox's Dairy and Concord Dairy. Brox Dairy has assured full <br />cooperation to insure against a repition of this situation, <br />and although the letter from Concord Dairy stated they objected <br />to our letter and requested more and frequent tests of their <br />products the Board felt that a warning letter for even one <br />high count was necessary to insure the residents of the highest <br />possible quality control. <br />B.L.CUMMINGS Mr. McQuillan reported that he had written a letter to <br />MILK CO. Mr. Lincoln Cole, Chairman of the Board of Selectmen, requesting <br />permission to either have Mr. Legro, Town Counsel, go to <br />court and take action regarding the restraining order on Mr. <br />Finneran in regard to B.L. Cummings Milk Co., or give the <br />Board permission to employ legal council to see this case <br />through. <br />Mr. West said he approved any action that would speed <br />the settling of the B.L. Cummings Case. <br />Mr. McQuillan said he felt Mr. Legro had done an excellent <br />job on the case but that he was so busy with other Town matters <br />he did not have the time to devote to getting this case settled <br />as quickly as possible. He also stated that he had consulted <br />two judges on this matter and they explained that a restraining <br />order was a temporary thing and they did not understand how it <br />could be carried on so long. He also understood that he or the <br />Board could demand that this restraining order be put on the <br />court calendar under an impartial judge and immediate action <br />demanded. <br />Mr. Finneran said as soon as the restraining order was <br />settled he could go to Concord Court and have the case that is <br />pending there heard and a decision made. <br />064 <br />1 <br />1 <br />1 <br />
