481 <br />BOARD OF HEALTH MEETING <br />MAY 22, 1961 <br />The regular meeting of the Board of Health was held Friday <br />May 22, 1961 at 3:00 P.M. in the Selectmen's Room of the Town <br />Office Building. Members present were Mr. R.L. McQuillan, Chair- <br />man, Dr. William Cosgrove and Health Officer, Mark D. Lurvey. <br />The minutes of the April meeting were approved as read. The <br />minutes of the Special Meeting, April 28, 1961 were approved as <br />read. <br />Mr. Steve Russian requested to come before the Board to dia- LOT 29 <br />cuss Lot 29, Rolfe Road. Mr. Russian said in tivo previous meetingsROLFE RD <br />one with the Board in April and the other with Mr. Cole, Mr. Lurvey <br />and Mr. McQuillan in the Health Office, he understood that if the <br />grading plans for Lot 29, Rolfe Road, submitted by EverettM. Brooks <br />Co., were approved by Whitman & Howard, Inc., then Mr. Lurvey would <br />sign the permit for the Building Department in order that a Building <br />Permit could be issued on this Lot. Mr. Russian further stated that <br />his client had not bought Lot 29, Rolfe Road and the only reason he <br />was pressing the issue of a letter to be written, approving Lot 29, <br />Rolfe Road, from Mr. Lurvey was a point of honor to him. <br />Mr. Lurvey explained that he, under explicit order from Mr. <br />Cole and the Board, could not write a letter approving Lot 29, Rolfe <br />Road unless a sentence stating that the Board of Health reserves <br />the right to approve or reject this Lot if the grading plans as <br />submitted fail to solve the problem of standing water on this Lot. <br />Mr. Lurvey further stated that no engineering company could posi- <br />tively guarantee that a certain grading plan would work without <br />first carrying out the plan. <br />Mr. Russian said he was trying to get this letter and plan <br />carried out at that time when his client was interested in Lot 29, <br />Rolfe Road. The question of dollars and cents was important to <br />his client. <br />Mr. Lurvey said as the plans stand now we see no reason why <br />they won't work but the Board cannot just say go ahead until the <br />grading is done and we see that it will solve the existing prob- <br />lem. When the grading is done a re -inspection will be made. <br />Mr. McQuillan and Dr. Cosgrove read Mr. H.S.B. White's letter <br />which stated that enclosed were the grading plans for Lot 29 Rolfe <br />Road anc, Lot 28 Fessenden Way, as prepared by Everett M. Brooks, Co. <br />Mr. White went on to say that it was their understanding that (1) <br />this plan had received approval of Whitman & Howard, Inc. as re- <br />quested by the Board at its meeting April 21, 1961, (2) That the <br />work represents all the work to be done and no additional require- <br />ments are to be imposed, (3) that the building permit will be iss- <br />ued when the work shown on the Plan is done (except for the grading <br />around the house and septic tank areas which is to be done after <br />installation of the foundation walls and sewage disposal system.) <br />Mr. Lurvey said he did not feel he should answer that letter <br />until he had talked to Harold Stevens, Town Council.
