Parker Room, Town Office Building 1625 Massachusetts Ave Chair Philip Hamilton opened the meeting at 6:32pm in the Parker Room of the Town Office Building Commissioners Present: Phil Hamilton, Alex Dohan, Kevin Beuttell, Dick Wolk, Ruth Ladd Others present: Karen Mullins, Conservation Administrator and Casey Hagerty, Conservation Department Assistant 6:32pm Issue Order of Conditions: DEP 201-1083, BL 1040, 55 Cary Ave Motion to issue the Order of Conditions for 55 Cary Ave made by Mr. Beuttell and seconded by Ms. Dohan. Vote: 5-0 in favor. Issue Order of Conditions: DEP 201-1082, BL 1039, 20 Pelham Road Motion to issue the Order of Conditions for 20 Pelham Road made by Mr. Wolk and seconded by Mr. Beuttell. Vote: 5-0 in favor. Issue Order of Resource Area Delineation: DEP 201-1075, BL 1032, Dunham and Webb Street Motion to issue the Order of Resource Area Delineation as modified on the revised existing wetlands resources map 46, parcels 64 and 155A dated 1/19/2018 (Revision 3) for Bordering Vegetated Wetlands pursuant to Mass Wetlands Protection Act Ch. 131 S. 40 and Lexington Wetlands Protection Code C. 130 as further described on page 2-A of 4 and pursuant to Lexington Wetland Protection Cod C. 130 as described on page 2-A of 4 made by Mr. Wolk and seconded by Mr. Buettell. Vote: 5-0 in favor. 6:38pm Approve Insignificant plan change: DEP 201-1074, BL 1031, 6 Peacock Farm Road Ms. Mullins explained that the applicant is proposing to change the location of the infiltration system. Motion to approve insignificant plan change made by Mr. Wolk and seconded by Mr. Beuttell. Vote: 5-0 in favor. 6:39pm Approve minutes from 1/8/2018 and 1/22/2018 meeting Motion to approve minutes of 1/8/2018 made by Ms. Dohan and seconded by Mr. Beuttell. Vote: 5-0 in favor. Minutes of 1/22/2018 will be reviewed at the next meeting. Schedule Site Visits for the Tuesday 2/20/2018 Meeting Site visits were scheduled for 2/17/2018 at 9am. Planning Board project comments Ms. Dohan explained that she attended a planning board meeting regarding lots along Granny Pond. She suggested the commission have more coordination with the Planning Board so they are aware of potential projects near wetlands. 6:46pm There were no reports 6:47pm Review Draft Buffer Zone Performance Standard Section 5(5) Amendment Proposal The commission discussed how the grandfather clause would factor into this new proposal. They decided that they would schedule a special meeting to discuss the regulation. 6:57pm pm Continued Hearings DEP 201-1087, BL 1044 NOI, Off Marrett Road, Old Reservoir Owner/Applicant: Town of Lexington Project: Dam Restoration Mel Higgins- Weston and Sampson, Michael Sprague- Town Engineer Documents: Plans 2/2/2018, Memo 2/2/2018 Mr. Higgins explained that since the last meeting, they have addressed the issues brought up by the commission. They were able to change the slope from a 3:1 to a 2.5:1 which decrease the amount of permanent disturbance from 1000sq. ft.to 250 sq. ft. They have also proposed two seed mixes for the downstream slope. They have updated the invasive species monitoring to include the MIPAG species and will monitor it for five years. They have talked with the recreation department regarding the Frisbee golf course and do not believe there will be any impacts. If there are impacts, they will temporally move the course and then replace it. They also spoke with the recreation department regarding access to the water for fishing. The recreation department stated that they felt there was not a need for water access along the dam. The applicant also spoke with the school department and the school is open to additional plantings on their property. 40 new trees are proposed to be planted. Questions and comments from the Commission: The commission stated that they would like to visit the replication area during construction to determine if that is the best location. The commission stated Ms. Mullins could act as their representative during this process. The commission asked if the rocks on the back of the slope could be covered with loam to help with the stabilization process. The applicant stated that they cannot because of water flow. Motion to close the hearing made by Mr. Wolk and seconded by Ms. Ladd. Vote: 5-0 in favor. 7:16pm DEP 201-1089, BL 1043 NOI, 45, 65, and 75 Hayden Ave Owner/applicant: King Street properties Project: New office building, garage, and associated site work Doug Hartnett- High Point Engineering, Jesse Agular- High Point Engineering, Rob Albrow- King Street Properties Documents: Memo 2/1/2018, Hayden Ave Sun Shadow Cast 2/5/2018, Conservation Restriction comparison plan 1/31/208 Mr. Hartnett explained that they are in front of the commission with some updated information. They have revised the Conservation Restriction so that it lines up with other Conservation Restrictions in the area. They have also added language about maintaining the utilities in the CR area. Mr. Hartnett stated that they have met with the Town's peer reviewer to discuss the stormwater aspect of the project. He addressed some of the issues raised in the peer reviewer. Mr. Hartnett stated the peer reviewer has requested more information TSS removal rates. They have coordinated with the Army Corps of Engineers to review the project. They have recalculated the shadow study in the fall and spring, but concluded that the time with the most shadow in the wetlands is in the summertime. There will only be 500 sq. ft. of disturbance during part of the day because of the shadow. More details regarding the pedestrian bridge were given. Questions and comments from the commission: The commission stated that they do want more information regarding the TSS removal. The commission stated that they want to see additional test pit resuilts. The commission stated that they want to see the edited language for the CR. The commission stated that they want the trail head parking spaces to be paved, not stone dust. The commission stated that they want the vernal pool labeled with buffer zones shown on plan. Motion to continue the hearing, at the applicant's request, made by Mr. Beuttell and seconded by Mr. Wolk. Vote: 5-0 in favor. New Hearings 7:50pm DET 18-1 RDA, 52 Percy Road Owner/Applicant: Cells Brisbin and Carolyn Silva-Brisbin Project: Septic abandonment and sewer connection Jack Sullivan- Sullivan Engineering Group, Celis Brisbin and Carolyn Silva-Brisbin- Home owners Documents: RDA package, Sewer Service Connection plan 1/3/2018, Engineering report 1/30/2018 Mr. Sullivan explained that this property has an old house on it which the owners are proposing to renovate from the interior. In the rear of the house is an old cess pool which they are proposing to decommission. Following the decommissioning, they are going to install a grinder and force main to pump the sewer to the town system. Erosion controls are proposed and any disturbance will be temporary. Questions and comments from the Commission: The commission stated that they are not approving the wetlands as part of this project. The commission stated that the applicant should be careful during the decommissioning because of the steepness of the slope. Motion to issue a Negative Determination with Conditions made by Mr. Wolk and seconded by Mr. Beuttell. Vote: 5-0 in favor. 7:57pm DET 18-2 RDA, 221 East Emerson Road Owner/applicant: Yacov Levy Project: home addition Yacov Levy- homeowner Documents: RDA package 1/16/2018 Mr. Levy explained that he is proposing to build an addition to his attached garage. No additional driveway area is proposed. Mr. Levy explained that there are wetlands on site but are greater than 100 ft. away from the proposed project. The neighboring property has had the wetlands delineated. Questions and comments from the Commission: The commission stated that they are not confirming the wetlands line on the property. Because of the neighboring delineation, they know that the project is greater than 100ft. from wetlands. Motion to issue a Negative Determination with Conditions made by Mr. Wolk and seconded by Ms. Ladd. Vote: 5-0 in favor. 8:02pm DEP 201-1084, BL 1041 NOI, 23 Coolidge Road Owner/Applicant: Timothy and Lauren Weeks Project: Home addition and associated site work Mike Derosa- Derosa Environmental, Timothy Weeks- Home owner Documents: NOI package 12/19/2017, Engineering report 1/30/2018, Stormwater report 1/11/2018, Site development plan 1/11/2018, Proposed plan of land 12/12/2017 Mr. Derosa explained that his client is proposing to put an addition on the house and slightly enlarge the driveway. Most of the work will be outside of the 100ft. buffer and stormwater management is proposed. He explained that they have not had a chance to do test pits yet, but are proposing test pits. Mr. Hamilton entered the Engineering Report into the record. Questions and comments from the Commission: The commission stated that they need a test pit to approve the project. The commission reminded the applicant about the Town storm water standards. The commission stated that they want the geotextile removed from the bottom of the system. Motion to continue the meeting to 2/20/2018 at the applicant's request made by Ms. Ladd and seconded by Mr. Beuttell. Vote: 5-0 in favor. 8:10pm DEP 201-1090, BL 1047 NOI, 22 Longfellow Owner: Ozan Dokmecioglu Applicant: John Degnan Project: Home addition John Degnan- builder Documents: Proposed site plan 1/31/2018, Stormwater report 1/31/2018, Engineering report 2/2/2018, NOI package with attachments 1/16/2018 Mr. Degnan explained that he is proposing to building a farmers porch on the front of the house and add a second story above the existing breezeway. Mr. Hamilton entered the Engineering Report into the record. Questions and comments from the Commission: The commission stated that they need a clear plan showing where the addition is located. The commission sated that the geotextile fabric should be removed from the bottom of the system. Questions and comments from the public: Rose Harvey, 21 Longfellow Road, asked what the concerns regarding water is with this project. Mr. Hamilton explained the commission's goals and what they aim to protect. Joe Leopore, 10 Longfellow Road, asked if the drainage on the property will change. He is concerned about flooding and drainage. MR. Hamilton explained that everything will continue to function in the same way. If the applicant wants to do any additional landscaping they will have to go to back to the commission. Vote: 5-0 in favor. 8:22pm DEP 201-1058, BL 1015 AOOC, 167-177 Cedar Street Owner/applicant: 167, 173, 177 Cedar Street LLC Project: Amend order to reflect changes to stormwater system and restrictive covenant Mike Novak- Meridian Associates, Ben Finnegan- Finnegan Development Documents: Request to amend OOC 1/15/2018, Engineering report 1/30/2018, Winding Road plans 1/15/2018, Wetland buffer area calculations Mr. Novak explained that they are back in front of the commission with some minor changes that the planning board has required. There are some slight changes to the Limit of Work line to make it consistent through the entire project. There is also a slight change in the in the shape and location of the infiltration system. The restrictive covenant has also been extended to all of the lots. Questions and comments from the Commission: The commission asked if the applicant could extend the Restrictive Covenant to the extend Limit of Work line. The applicant stated that they could do this. The commission stated that they applicant can remove the debris behind lot 10. They will add that as a condition. Motion to close the hearing made by Mr. Wolk and seconded by Mrs. Dohan. Vote: 5-0 in favor. 8:35pm DEP 201-XXXX, BL XXXX ANRAD, 1 Concord Ave Owner: Belmont Country Club Applicant: ND Acquisitions LLC c/o National Development Project: Confirmation of wetlands line Mr. Beuttell recused himself from the hearing. Marl Arnold- Goddard Consulting, Steve Senna- National Development Documents: ANRAD package 1/16/2018, Plan to accompany ANRAD 1/15/2018 Mr. Arnold explained that the Belmont Country Club has a portion of land in Lexington. Part of that that has very steep slopes with wetlands at the toe of the slope. Beaver Brook also runs though the property and a wooded swamp. Mr. Arnold explained that he has delineated the wetlands on the site as well as the annual mean high water level. Questions and comments from the Commission: The commission discussed the definition of the mean annual high water level. They has also had questions about the channel widths and where the water is increasing. Based on observations made at a site visit on February 3, the commission had questions regarding the location of the mean annual high water line. The commission stated that they will need additional data sheets. The commission stated that they are thinking about getting a peer reviewer. Motion to continue the hearing to 2/20/2018 at the applicant's request made by Mr. Wolk and seconded by Ms. Dohan. Vote: 4-0 in favor. 8:55pm Continued Hearings DEP 201-1080, BL 1037 NOI, 81 Westview St. Owner: Cheryle West Applicant: Nash Quadir, KUQ Construction Project: Raze and rebuild SFD and associated site work Nash Quadir- builder Documents: Existing conditions plan of land 2/5/2018 Mr. Quaidr explained that he has met with the Town Engineering Department and there is no longer any confusion regarding the survey. Motion to close the hearing made by Mr. Wolk and seconded by Mr. Beuttell. Vote: 5-0 in favor. 8:59pm DEP 201-1088, BL 0145 ANOI, 246 Worthen Road East Owner/applicant: Mukund Srinivasan Project: Home addition Chi Man- Hardy Engineering Documents: Site design plan 1/29/2018, Stormwater report 1/31/2018, Engineering report 2/2/2018 Mr. Man stated that since the last meeting, he has addressed the engineering department comments. He has also added to cleanouts to the system. Mr. Hamilton entered the Engineering report into the record. Motion to close the hearing made by Mr. Wolk and seconded by Mr. Beuttell. Questions and comments from the Commission: The commission stated that the proposed restoration plan is not acceptable. The applicant will have to present a plan from a wetlands scientist. The commission stated that they want FENO markers on the site. Motion to continue the hearing to 2/20/2018 at the applicant's request made by Mr. Wolk and seconded by Ms. Dohan.
