HomeMy WebLinkAbout1985-09-129 LEXINGTON BOARD OF APPEALS September 12, 1985 Pursuant to notice in the Lexington Minute -Man, a newspaper of general circulation in the Town, published on August 29 and September 5, 1985 and notice sent by mail, postage prepaid,to all interested parties pursuant to the provisions of Massachusetts General Laws, public hearings were held in the Town Office Building on the petitions listed below. Acting on the petitions were: Chairman Thomas G. Taylor, Clarence D. Turner and Associate Members: Susan S. Beck, William C. Hays and Robert V. Whitman. 21 Winthrop Road: William Hutchins requested a special permit in accordance with Zoning By -Law Section 7.4.9 and 3.3 for the continued use of a three car garage, thought to have been constructed in the 1920's, as located on the premises. 531 Massachusetts Avenue: Arthur Ryan and Francis Molle requested a variance of dimensional controls, Zoning By -Law Section 7.4.1 b, to allow the house at 531 Massachusetts Avenue to be enlarged by constructing additional stories on top of the existing structure, one corner of which is 14 feet instead of 15 feet from the side lot line. 91 Hartwell Avenue:- Mortimer B. Zuckerman and Edward H. Linde, Trustees of 91 Hartwell Avenue Trust (formerly 85 Hartwell Avenue Trust) c/o Boston Properties requested a special permit, in accordance with Zoning By -Law Section 10.1.4 and ' 10.4.4 (c), Sign Regulations, to erect and maintain one double-faced standing non -illuminated sign at 91 Hartwell Avenue. 10 Independence Avenue: Elizabeth and Jon Westling requested a variance of dimensional controls, Zoning By -Law Sections 6 and 7 and Table 2, side yard setback, for an addition to the house. The addition will be no closer to the side lot line than the existing house. 196 Woburn Street: David Modoono requested a special permit, in accordance with Sections 3.3 and 5.5 and Table 1 - Use Regulation Schedule, lines 3.2 and 3.5, to operate a commercial greenhouse, retail nursery (including supplementary items) and sale of Christmas trees and wreaths in season. Decisions filed with the Town Clerk. 21 Winthrop Rd. - SP granted by unanimous vote. 531 Mass. Ave. - Variance granted by unanimous vote. 91 Hartwell Ave. - SP granted by unanimous vote. 10 Independence Ave. - Variance denied, 4 to 1 (Robert V.
