LEXINGTON BOARD OF APPEALS <br />July 14, 1983 <br />The Board held a regular meeting in the Selectmen's Meeting Room at 7:30 p.m. <br />Present and acting on petitions were: <br />Natalie H. Riffin, Acting Chairman <br />Robert M. Gary <br />Associates: <br />Laurence K. Redgate <br />Willaim C. Hays <br />Eric T. Clarke <br />Public hearings were held on the following petitions. <br />23 Pearl St., Stephen Puleo requested a special permit, pursuant to Section 5.7, to <br />maintain an above ground swimming pool and a variance from dimensional controls, <br />Section 5.7.1 (a) to allow the pool to have less than the required 15 ft. side yards. <br />31 Sherman St., Brian & Kathleen Mackintosh requested a variance of dimensional <br />controls (side yard requirement) to allow additions to the house, which is in an RS <br />zone. House builtcirca1890 (ref. ZBL Sections 6.3, 7.4 and Table 2). <br />6 Vaille Ave., Thomas E. O'Neill requested a variance from Table 2, dimensional con- <br />trols to move a garage to a new location on property. Garage will have less than <br />the required side yard. <br />' 159 Reed St., Joseph V. and Brenda J. Rosetta requested a variance from dimensional <br />controls to enclose front porch and add a deck (ref. ZBL Sections 6 & 7) and a <br />special permit (Section 7.4.9) to maintain existing house as located with insuffici- <br />ent setback and side yard. <br />70 Westview St., Dupree Associates requested a special permit (SPS) in accordance <br />with ZBL Section 3.4, for construction of a three-story, 62,000 sq. ft. office build- <br />ing (ZBL Table 1, all uses under 4 & 7.1 and 7.2) at 70 Westview Street, which is in <br />the CM Zone. The applicant requested the time period for the special permit to be <br />three years. <br />Decisions filed with the Town Clerk. <br />23 Pearl St. - SP and Variance granted unanimously. <br />31 Sherman St. - Variance granted unanimously. <br />6 Vaille Ave. - Variance granted unanimously. <br />159 Reed St. - SP granted unanimously to allow house to remain as located; and <br />- Variance to enclose porch so living room may be enlarged. <br />- Variance DENIED - to add a deck which would increase the non -conformity. <br />70 Westview St. - SPS granted by 4 to 1 vote (Wm. C. Hays voting in negative) <br />Board denied the 3 year time period requested for the SPS. <br />The meeting adjourned at 11:31 p.m. <br />Respectfully submitted, <br />Evelyn F.
