HomeMy WebLinkAbout1977-11-10BOARD OF APPEALS ' November 10, 1977 The Board of Appeals held a regular meeting on Thursday, November 10, 1977, beginning at 7:30 p.m., in the Selectmen's Meeting Room, Town Office Building. Present: George P. Wadsworth, Chairman Ruth Morey, Vice Chairman Woodruff M. Brodhead Thomas G. Taylor Robert M. Gary, Associate Public hearings were held on the following petitions, notices of the hearings having been mailed and hearings advertised in the Lexington Minute -Man newspaper as required by statute. Francis A. Drake - special permit to affix a directional sign (3' x 12 1/2') to building at 401 Lowell Street, to direct customers to cabinet showroom and office. Location of sign to be on side of building facing Woburn Street and Lowell Street; or permission to install approximately 4' from end of driveway, a free standing sign (3' x 5') and approximately 9' from ground to bottom edge of sign; or some other sign which would meet the Board's approval for identification or directional Taftoses. David E. Gompers - special permit, pursuant to Section 13 of Lexington Zoning By- laws, to construct a building (approximately 113,000 sq. ft.) at the property des- cribed herein: Land in Lexington, Mass. shown as Lot #1 and Lot #2 on a plan in Lexington, filed in the Land Registration Office for the Southern District of Middlesex County with Certificate #139005 in Book #785, Page #45. The premises are further described in Certificate of Title #134333 recorded in said Registry in Book #801, Page 183, and also shown on Lexington Property Map 80, Lot 4. Petitioner has an option to purchase said land. SMM Realty Corporation — special permit (12.2) to build and use two office and research buildings, each two stories in height and each 30,000 sq. ft. on its 5.45 acre site at 1-5 Forbes Road, pursuant to Sections 13, 25.40, 25.41, 25.42 and 25.71 of Lexington Zoning By-law. Also requested are variances (12.3) to allow: (a) the construction of the buildings to have front yards of less than 100 feet abutting Forbes Road (building A, 75 feet and building B, 60 feet) and to allow building B to have a rear yard of 58 feet from an RO district instead of the required 100 feet, which conditions vary from Section 27 (Dimensional Controls) and Section 26; (2) the use of 29 parking spaces servicing the buildings which are located within 50 feet of an RO District and 12 feet of a side lot line, 25 feet being required, in variance with Section 32.2 (Parking & Loading); and (c) the use of Parking Spaces having a 9 foot width and 18 foot length in variance with Section 40. Margery H. Howard and Robert R. Howard, Jr. - use variance on their property at 82 Waltham Street. They propose the following: 1. To rent the first floor to Casco Real Estate, Inc. for use as a real estate sales office. ' 2. To rent the second floor of the subject dwelling to a private individual as a residence only. 3. To remove the existing sheds and barn and grade their present location as a gravel surfaced parking lot for the use of the tenants as above and their clients and company only. Board of Appeals (continued) - Hearings November 10, 1977 -2 ' DECISIONS: The Board made the following decisions, all in open meeting. See decisions filed with the Town Clerk and in Board of Appeals' files for more details. Drake - granted, a free standing sign, subject to certain conditions, unanimously. Gompers - withdrawn by Petitioner. SMM Realty - withdrawn by Petitioner. Howard - granted, 4 to 1, Robert M. Gary voting in opposition. Permit for Vari- ance is subject to certain conditions.
