HomeMy WebLinkAbout1977-09-08BOARD OF APPEALS September 8, 1977 ' The Board of Appeals held a regular meeting on Thursday, September 8, 1977, beginning at 7:30 p.m., in the Selectmen's Meeting Room, Town Office Building. Present: George P. Wadsworth, Chairman Ruth Morey, Vice Chairman Woodruff M. Brodhead Irving H. Mabee Thomas G. Taylor Public hearings were held on the following petitions, notices of the hear- ings having been mailed and hearings advertised in the Lexington Minute -Man newspaper as required by statute. Joel and Paula Slotkin - variance of Section 27 of the Lexington Zoning By-law, pursuant to Section 12.3, to maintain an existing garage at 7 Locke Lane, which garage has a frontyard setback of 24 feet instead of the required 30 feet. Steven A. and Joan Z. Clark - variance of Section 27 of the Lexington Zoning By- law, pursuant to Section 12.3, to maintain a garage at 13 Rumford Road, which garage has a frontyard setback of 27.8 feet instead of the required 30 feet. Robert B. Ullian and Annette C. Ullian, 3 White Pine Lane - variance of Section 27 of the Lexington Zoning By-law, pursuant to Section 12.3, to construct a carport which will have a 22 foot frontyard setback instead of the required 30 ' feet. Robert P. Miller, D/B/A Waltham Street Mobil located at 396 Waltham Street - special permit to install Mini Serve and Full Serve Island designating units at the end of each of three gasoline islands. Carmella R. Braswell, 143 Reed Street - special permit for a period of five (5) years to install a telephone switchboard for the purpose of operating a telephone answering service under the name of The Battlegreen Answering Service. (See Zon- ing Bylaw Sections 12.2, 25.23 and 25.81:) A special permit was granted by the Board of Appeals on March 31, 1977 to Mrs. Braswell for one year. DECISIONS: The Board made the following decisions, all in open meeting. See decisions filed with the Town Clerk and in Board of Appeals' files for more details. Slotkin - granted unanimously. Clark - granted unanimously. Ullian - granted unanimously. Miller (Waltham Street Mobil) - granted 4 to 1, George P. Wadsworth dissenting. Braswell - granted, subject to conditions, unanimously. Other Discussion: Section 25 (Use Regulation Schedule), Section 30 (Non -conform- ing Uses), Section 40 (certain definitions), Agriculture, Greenhouses, Nurseries and Roadside Stands, all continue to bring forth discussion because"wording" of those sections is interpreted differently by individuals.
