Taylor Natalie Riffin, Associate Robert M. Gary, Associate Clarence D. Turner, Associate The Board of Appeals met in the Selectmen's Meeting Room of the Town Office Building for the purpose of voting on whether the Board will or will not hear a second petition of Lexington Enterprises, Inc., d/b/a Peking Garden Restaurant, 27 Waltham Street. The first petition had been denied on January 27, 1977 by a vote of2 in favor, 3 in opposition. A letter dated March 9, 1977, from the Planning Board was read by the Chairman. Letter stated Planning Board's reasons justifying a rehearing. *** Before the vote on whether the Board will or will not hear a second petition of Lexitgton Enterprises, Inc., d/b/a Peking Garden Restaurant, 27 Waltham Street, Irving 4. Mabee and Thomas G. Taylor announced that they would abstain from voting on thisiissue. ' Following discussion Clarence D. Turner made a motion to rehear a second petitiois. Ruth Morey seconded the motion. The motion to hear a second petition of Lexington Enterprises, Inc., d/b/a Peking Garden Restaurant, passed unanimously, Clarence D. Turner, Ruth Morey, Natalie'H. Riffin, Robert M. Gary and George P. Wadsworth voting in favor. The hearing date was set for April 7, 1977. Regular members except those who had ';abstained (Mabee and Turner) would "sit" for this hearing, also Associates Natalie'H. Riffin and Robert M. Gary. Other discussion: Tho Board discussed informally the zoning articles (especially 74 through 88)* proposed to be presented to the Annual Town Meeting by the Planning Board. No formal action was taken by the Board at this time. The meeting adjourned at 9:55 p.m. Respectfully submitted, Evelyn F. Wadsworth, Chairman Board of Appeals Letington, Massachusetts Dear Dr. Wadsworth: The Planning Board met with representatives of Lexington Enterprises, Inc. on February 7, and again on February 14, 1977- During these discussions we were apprised of the following: 1.'A revised interior layout, which you now have, has been prepared which will provide improved access to the rear parking area. 2.;The petitioners consultant on odor control and dispersion, Dr. ?Melvin W. First, has recommended changes to their venti- lation. system such as the addition of charcoal traps and an increase in vent stack height. Plans are in preparation for implementing these recommendations. 3.'Arrangenents have been made with the Battle Green Inn on Massachusetts Avenue for off-street parking of twenty cars between 9 a.m. and 6 p.m. Each of the above items appears to be in response to specific criticism of the previous petition raised by members of your Board. The ability and willingness of the petitioner to respond to these criticisms was in our opinion evidence of his desire to meet the objections raised. The Planning Board felt that the petitioners response to your permit denial created significant added information and/or circumstances, none of which had been previously presented to the Board of Appeals, and therefore justified a rehearing of the request for a special permit. Accord4.ngly, the Planning Board voted 4 to 0, Dr. Eric Clarke being absent but concurrir.r, on February 14, 1977, to consent to a rehearing under the provi:b.::,s of Mass.
