A regular meeting of the Lexington Board of Appeals was held on Tuesday,
November 28, 1972 at 7:30 p.m. in the selectmen's meeting room of the Town
Office Building. Present were Chairman Nickerson, regular members Sheldon,
Dawes, Wadsworth and Mrs. Morey.
Public hearings were held on the following petitions, notice having been
mailed to the petitioners, to the owners of all property deemed by the Board
to be affected thereby as they appear on the most recent local tax list, to
town boards and officials who will or might be affected by decisions made,
and also advertised in the Lexington Minute -man:
Peter S. Pershan and Patricia B. Pershan - petition for a variance to sub-
divide the property located at 218 Follen Road, having a frontage of 120 feet
and total area of 13,123 square feet of land, into two lots as follows: (a)
a legal building lot having a frontage of 120 feet and total area of 11,898
square feet of land; and (b) a lot containing 1,225 square feet of land to be
added to and made a part of the property known as 7 Churchill Lane, all as
shown on the plan submitted.
Ida G. Krebs - petition for a special permit under Section 25.21 of the Lex-
ington zoning by-law to construct a building at 453 Concord Avenue, Lexington,
to be used as a motor training facility, to accommodate the total of the ex-
isting school population of fifty (50) students and teacher personnel of nine-
teen (19) persons. The building will be approximately 52' x 74' and one story
high. At times other than assembly, there will be on the average approximately
twenty-five (25) students and ten (10) supervisory personnel using the facility.
There will be no new students enrolled or additional personnel employed for
this facility.
Cabot, Cabot & Forbes by Thomas P. Hutchinson - petition for a variance from
Article 10 of the Lexington Building By -Law and other applicable provision
thereof, unless the Building Inspector determines the same to be unnecessary,
so as to permit construction and use of a 2 -story building on this lot of
second-class construction with an area between firewalls not exceeding 40,533
sq. ft., the area limit now being 16,667 sq. ft. when certain sprinklers and
exterior fire fighting space are installed and provided as set forth in the
Article. The address is 3 Forbes Road (formerly 2 Forbes Road), the owner is
Trustees of Lexington Office Center Trust, Boston, Mass. (Cabot, Cabot &
Forbes), the plans are for Honeywell Radiation Center.
Herbert D. Kline - petition for permission under Section 26.56 to vary the
zoning by-law in order to erect and maintain an amateur radio antenna that
will have a maximum height of 75 feet on the property known as 25 Webster Road.
(65 feet allowed) The antenna will be on a tower that also retracts to a
height of 26 feet and is motorized so that it can go up or down by depressing
a switch. The tower base will sit in concrete and the whole will measure 7'
wide x 7' high x 7' deep (approx. 9 cu. yards).
Albert E. Whitcomb - petition for a variance in the required distance from the
street in order to build a one-story addition to the dwelling at 29 Fern Street.

' The addition will be 16 ft. x 21 ft. 6 in., one story in height, and will con-
sist of a bedroom and bathroom. The addition will be attached to the side of
the existing building which has been there since before the year 1900. The
front of the existing building is approximately 17 ft. from the street line.
The addition will be in line with the front of the existing building and will
be the same distance from the street.
Lexington Gardens, Inc. by E. Lee Schneider, President - petition for a special
permit under subsections 12.2 and 24.5 of the zoning by-law to store and sell
in conjunction with the operation of a nursery at 93 Hancock Street, Lexington,
all of the supplementary items specified in the subsection 24.5.
Following the hearings the Board made the following decisions, all in
open meeting and all unanimous.
Peter S. Pershan and Patricia B. Pershan - granted.
Ida G. Krebs - granted, with the condition that the building must be built of
second class construction and subject, also, to the following:
1. The number of students shall not exceed 50.
2. Any drainage problems must be satisfied and in conformity with the Hatch
Act requirements.
3. Board of Health and Fire Department regulations must be met.
4. Construction of the building must be started within one year.
Honeywell Radiation Center (Cabot, Cabot & Forbes) - granted, subject to the
conditions agreed upon in the request and the condition recommended by the
Building Inspector that the stair enclosures for all three stairways be of not
less than a 2 -hour fire resistant rating shall be met and all conditions of
the finding and determination granted August 1, 1972.
Herbert D. Kline - denied. (65 ft. tower is allowed according to the by-law
without a special permit or variance)
Albert E. Whitcomb - granted, subject to the condition that construction be
started within one year.
Lexington Gardens, Inc. - granted, subject to the following conditions:
1. This special permit shall terminate two years from date, subject to the
right of the Board to extend the permission from time to time. (expira-
tion date, November 28, 1974)
2. The sale of any goods or items not listed in subsection 24.5, paragraph 1
is prohibited.
All pertinent material is on file under the name of each petitioner in
the Board of Appeals' office.
