May 2, 1972
A regular meeting of the Lexington Board of Appeals was held on Tuesday,
May 2, 1972 at 7:30 p.m. in the selectmen's meeting room of the town office
building. Present were Chairman Nickerson, regular members Dawes, Sheldon
and Wadsworth and associate member Woodruff M. Brodhead.
Public hearings were held on the following petitions, notice having been
mailed to the petitioners, to the owners of all property deemed by the Board
to be affected thereby as they appear on the most recent local tax list, to
town boards who will or might be affected by decisions made, and also adver-
tised in the Lexington Minute -man:
James V. Cosgrove - permission to continue operation of a roadside stand at
307 Wood Street for the purpose of selling poultry, eggs, plants, produce and
wood; also to sell Christmas trees and wreaths in season.
Calvin H. & Virginia Brandford - variance in order to build and maintain a
pool on the property at 2416 Massachusetts Avenue, which will leave a rear
yard of 12 ft. instead of 15 ft. on the north side. Also on the west and
east sides variances of 5� ft. and 2� ft. respectively to maintain the re-
quired 10 ft. side yards.
Emanuel and Karen A. Schnall - permission to maintain the existing dwelling
at 10 Fiske Road as presently constructed, with a northwest side yard of
approximately 12 ft. instead of the required 15 ft. This side yard is deter-
mined by the original structure, completed in 1955 and not specifically cov-
ered by a variance granted for an addition in 1961. Said addition was built
to less than the dimensions permitted.
Marilyn M. and Keith W. Harrison - permission to erect a hanging sign at 72
Waltham Street, the location of the Golden Hand, a fabric shop. The two-
faced sign, measuring 33 inches by 50 inches, would be hung from the center
column of the front porch over the front hedge. It would not overhang the
sidewalk.
Following the hearings the Board made the following decisions, all in
open meeting:
James V. Cosgrove - granted unanimously with the following conditions:
1. This permit is granted under Section 25.33 of the zoning by-law.
2. Only one sign shall be permitted and that attached to the front of
the stand. The lettering shall be no higher than 12".
3. The hours of operation shall be no later than 9:00 p.m., seven days
a week.
4. The premises shall be kept in a more neat and orderly condition at
all times, and that consideration be given to blacktopping the
driveway.
5. There shall be no excessive flood -lighting of the stand or the area.
6. Parking areas shall be provided so that there will be no parking on
Hartwell Ave. or on Wood St.
7. This permit shall expire July 1, 1974.

Calvin H. and Virginia Brandford - granted unanimously subject to the follow-
ing conditions:
1. Fencing shall completely surround the pool and be of adequate height.
2. The gate shall be self closing and self latching.
3. There shall be no flood lighting bothersome to neighbors.
4. The pool shall not be illuminated and used after 10 p.m.
Emanuel and Karen A. Schnall - granted unanimously.
Marilyn M. and Keith W. Harrison (Golden Hand Fabric Shop) - granted on a
vote of 4 to 1. Chairman Nickerson voted in opposition to the granting of
this free standing sign. This permission is subject to the following
conditions:
1. The Historic Districts Commission shall dictate their approval of
the design and color.
2. The bottom of the sign shall be 6 feet above the ground and anchored
to the building.
3. No lighting of the sign will be required.
All pertinent material is on file under the name of each petitioner.
The meeting adjourned officially at 9:30 p.m.
