HomeMy WebLinkAbout1947-04-1012 BOARD CF'APPEALS MEETING April 10, 1947 A meeting of the Board of Appeals was held in the Selectmen's Room, Town Office Building on Thursday evening, April 10, 1947. Chairman Locke, Mr. Brown and Associate Members Ballard and Ripley were present. The Clerk was also present. The meeting was held for further discussion on the petitions of Lewis Pollard and Joseph Kelly. Public hearings of these petitions were first held on April 41, 19473, and adjourned until this evening. At 8:00 P.M., Mr. Lindstrom, Building Inspector, entered the meeting. He stated that his reason for putting Mr. Kelly's petition before the Board was because he was not sure that the.f rost might not get down under the grade beam and heave it. The frost from the outside might get down in and start to heave from the edge. As long as a person is living in the house, the chances are slighter that this would occur, but if the house were left alone, and the heat shut off, there would be a change of frost getting in and lifting the beam. There are some of these houses in Braintree, but Mr. Lindstrom does not feel that we have had severe enoughi: winters for the past few years to really test this type of construction. He doubts very much that #)e grade beam would withstand pressure from the frost. Mr. Lindstrom retired at 9:20 P.M. The Board considered the application of Mr. Pollard. Upon motion of Mr. Brown, seconded by Mr. Ballard, it was unanimously voted that the appli- cation be denied in the following form: 1 i 12a BOARD OF APPEALS.DENIAL The Board of, Appeals, acting under the Lexington Zoning By-law and General Laws, Chapter 40, Sections 25 to 30A as amended, having rdceived a written petition addressed to it by Lewis W. Pollard a copy of which is hereto annexed, held a public hearing thereon of which notice was mailed to the petitioner and to the owners of all property deemed by the Board to be affected thereby as they appear on the most recent local tax list, and also advertised in the Lexington Minute -Man, a newspaper published in Lexington, which hearing was held in the Selectmen's Room, in the Town Office Building on April 4, 1947. Three regular and two associate Members of the Board of Appeals were present at the hearing. A certificate of notice is hereto annexed. At this hearing evidence was offered on behalf of the petitioner tending to show: That Lewis W. Pollard requested permission to construct, on Lot #1 Lincoln Street, Lexington, as shown on pian of Five Forks Village in Lexington, Mass., dated Mar. 28, 1946 by Miller and Nylander, Civil Engrs., a house designed by the K. V. Wolsey Company, Inc. designated by them as "America's ko. 1 Home". This prefabricated house would substantially vary from the Building Laws of the Town of Lexington. Evidence was offered on behalf of citizens opposing the granting of the said petition tending to show: No-one appeared in opposition.
