HomeMy WebLinkAbout1944-01-07• • BOARD OF APPEALS A meeting of the Board of Appeals was held in the Selectmen's Room, Town Office Building on Friday, January 7, 1944 at 9:00 P.M. Messrs. Locke, Maddison, Bowker and Associate Members Brown and Redman were present. The Clerk was also present. Mr. Locke served as Chairman in the absence of Mr. Glynn. At 8:00 P.M. hearing was declared open upon the petition of Luigi Ferrazzani for permission to alter the dwelling at 673 Waltham Street, Lexington, so as to accommodate two families. The notice of the hearing was read by Mr. Bowker. Mr. Ferrazzani and his son, John Ferrazzani, were the only persons present at the hearing. Mr. Locke asked Mr. Ferrazzani to explain to the Board what changes he wished to make in the house. Mr. Ferrazzani replied that he wished to make the house into a two-family residence, one apartment upstaris to be occupied by his son. Mr. Locke asked if Mr. Ferrazzani lived in the house at the present time and he replied in the affirmative. Mr. Locke asked how many rooms there are now and Mr. Ferrazzani replied that the house now contains twelve rooms. Mr. Locke asked if anything had been done relative to obtain- ing plans for the proposed alterations and Mr. Ferrazzani said that he just wanted to make a kitchen and bathroom on the second floor. Mr, Locke asked how the house would be divided and Mr. Ferrazzani said that the new apartment would be on the second floor. Mr. Locke asked how many front doors there were and Mr. Ferrazzani said that there would be one front door for the upstairs apartment. Mr. Locke asked if there would be any changes in the outside appearance of the house and Mr. Ferrazzani's son, John, replied that there would be no changes. Mr. Locke asked if John were going to live in the proposed apartment and he replied that now his mother, father, sister and he occupy the house. He is going to be married and will live in the apartment on the second floor. Mr. Bowker asked if the Ferrazzani family had lived in this house very long and John replied that they had been there since 1925. Mr. Bowker asked if there would be six rooms upstairs and six rooms downstairs. John Ferrazzani replied that there would be only four rooms upstairs. 95 Mr. Locke asked if the rooms on the front of the • house would be a part of the apartment in question and John replied that they would not. Mr. Redman asked if the only change upstairs would be to make one of the rooms into a kitchen and John replied in the affirmative. Mr. Locke asked if these rooms upstairs would have a separate entrance and would be entirely separate from the rest of the house. John replied that that was correct. Mr. Ferrazzani and his son retired at 8:07"P. M. The Board discussed the request and felt that in this particular location, and with the desire of the family to be together, that no harm would be done to any others who might later be affected. Upon motion of Mr. Maddison, seconded by Mr. Bowker, it was unanimously voted to grant the petition ih the following form: BOARD OF APPEALS PERMIT The Board of Appeals, acting under the Lexington Zoning By-law and General Laws, Chapter 40, Sections 25 to 30 as amended, having received a written petition addressed to it by Luigi Ferrazzani, a copy of which is hereto annexed, held a public hearing thereon of which notice was mailed to the • petitioner and to the owners of all property deemed by the Board to be affected thereby as they appear on the most recent local tax list and also advertised in the Lexington Minute -Man, a newspaper published in Lexington, which hear- ing was held in the Selectmen's Room, in the Town Office Building on the 7th day of January, 1944. Two Associate and three members of the Board of Appeals were present at the hearing. A certificate of notice is hereto annexed. At this hearing evidence was offered on be- half of the petitioner tending to show: That the building located at 673 Waltham Street is owned by the petitioner; it consists of 12 rooms, and that he wished to provide an apartment on the back of the second floor of the house con- sisting of 4 rooms. This apartment shalla be separate from the rest of the house; that at the present time there are three outside entrances,and, without making any changes to the exterior, one of these entrances will be used as the entrance to the second floor apartment. It will be neces- sary to provide a kitchen as well as ,s bathroom facilities. The upstairs apartment will be occupied by a son of the petitioner. At the close of the hearing the Board in private session on January 7, 1944 gave consideration to the sub- ject of the petition and voted unanimously in favor of the following findings: 0 • 0 1. That in its judgment the public convenience and welfare will be substantially served by the making of the exception requested. 2. That the exception requested will not tend to im- pair the status of the neighborhood. 3. That the exception requested will be in harmony with the general purposes and intent of the regulations in the Lexington Zoning By-law. 4. That owing to conditions especially affecting the said parcel but not affecting generally the Zoning district in which it is located, a literal enforcement of the pro- visions of the Lexington Zoning By -Law as to the locus in question would involve substantial hardship to the petitioner and that desirable relief may be granted without substantially derogating from the intent or purpose of such Lexington Zoning By-law. Pursuant to the said findings, the Board hereby unanimously decides that the application of the Lexington Zoning By-law is hereby varied so far as may be necessary to permit Luigi Ferrazzani to alter the dwelling located at 673 Waltham Street to accommodate two families subject to the following conditions: 1. That there shall be no alterations on the exterior of the building. 2. That this permit shall be in force only as long as one apartment is occupied by a son or daughter of the petitioner. 3. That a bathroom shall be provided with each apartment. 4. That the premises shall be kept in good repair. The Board hereby makes a detailed record of all its proceedings relative to such petition and hereby sets forth that the reasons for its decision: are its findings hereinbefore set forth and the testimony presented at the said hearing, including that herein summarized, and directs that this record immediately following this decision shall be filed in the office of the Town Clerk of Lexington and shall be open to public inspection and that notice of this decision shall be mailed forthwith to each party in interest.
