Burt Perlmutter, M.D., served as meeting acting Chair Person. Charles Hornig, Planning Board, gave an informal presentation to the Board about the Articles being presented at Town Meeting. Mr. Hornig addressed Article 40, Accessory Apartments, and whether this bylaw change would affect the Lexington Board of Health. The Board reviewed the zoning bylaw, and determined that this bylaw was not within the purview of the Board of Health. Rick Reibstein gave an informal presentation to the Board on Potential Toxic Waste Reduction Opportunities. Mr. Reibstein reviewed the opportunities he and his colleagues typically found at facilities across the state, for reducing risks and exposures while maintaining or improving operations. The Community Health report was reviewed and the following topics were discussed; Community Health and Infectious Disease Report: Director Cody informed the Board about two training sessions to take place in June, hosted by the Office of Public Health. Youth Mental Health First Aid, will introduce common mental health challenges for individuals, and teaches a 5-step action plan for how to help people in both crisis and non-crisis situations. The Environmental Health report was reviewed and the following topics were discussed; Environmental Health Report was reviewed for various inspections conducted by the Health Agent. Bollywood; Over the past 4 years the establishment has had numerous violations. Recently the establishment has hired the services of Lisa Berger, food consultant. The Director reviewed this establishments’ progress since working with a food consultant. Sarah Wasser, Partea, recently completed a Residential Kitchen Food Permit Application with the Office of Public Health. Ms. Wasser was there to meet the Board and request a permit to operate a Residential Kitchen. Partea had completed a pre-operational inspection, and answered \[ĻǣźƓŭƷƚƓ.ƚğƩķƚŅIĻğƌƷŷaźƓǒƷĻƭͲağƩĭŷЊЏͲЋЉЊЏtğŭĻЋƚŅЌ various questions from the Board. After much discussion, David Geller, M.D., proposed a motion that stated, “The Lexington Board of Health grants an Annual Permit to Operate a Partea Residential Kitchen to at 150 Worthen Road.” Sharon MacKenzie R.N., Seconded the motion. All were in favor. The Director reviewed the recent MEHA Annual Meeting with the Board. State Sanitary Code Case Reviews: The Board reviewed the State Sanitary Code Case for 81 Westview Street, 27 Vaille Avenue, and 16 Hancock. 81 Westview Street; Cheryl West came before the Board. She purchased the home at 81 Westview Street in November of 2015. This home was declared unfit for human habitation by the BOH over 15 years ago. The purpose of the meeting was to provide an update to the BOH about the current activities that are taking place on site. After much discussion David Geller, M.D., proposed a motion that stated, “The Lexington BOH has learned that a new owner of 81 Westview, Cheryl West, has plans to bring the property into compliance with the state sanitary code. The BOH is not opposed to activities that relate to improving the property so that it is in compliance with the state sanitary code and any other town requirements for building, planning, conservation, zoning, and fire Department.” Sharon MacKenzie R.N., Seconded the motion. All were in favor. 27 Vaille Avenue; previously, Lead was detected, along with several other State Sanitary Code violations. The case is currently an ongoing criminal complaint case. 16 Hancock Street; Mr. Cody informed the Board that on March 5, 2016 at approximately 4:32 PM, Lexington Dispatch notified him that 16 Hancock Street was found to be in deplorable condition. After being invited in by the occupant, the home was declared unfit for human habitation under the emergency condemnation conditions as described in the State Sanitary Code. Occupants vacated dwelling. 24 Trauma has signed a contract with the family to continue cleanup efforts. After much discussion Sharon MacKenzie R.N., proposed a motion that stated, “The Lexington Board of Health will allow the dwelling at 16 Hancock Street to be re-occupied upon the property owner agreeing to the following requirements; 1.) Smoke and Carbon Monoxide detectors must be installed throughout the dwelling, 2.) Building must confirm that the structure is sound, 3.) Heating system must pass plumbing inspector requirements, 4.) Kitchen must have working stove, working sink free from leaks, and working refrigerator / freezer, 5.) Dwelling space must remain sanitary and clean. Hire a professional cleaning \[ĻǣźƓŭƷƚƓ.ƚğƩķƚŅIĻğƌƷŷaźƓǒƷĻƭͲağƩĭŷЊЏͲЋЉЊЏtğŭĻЌƚŅЌ contractor to perform bi weekly cleaning services for bathrooms, kitchen and living space, 6.) Restrict access (within reason of all building and Fire codes) to parts of the home that are in disrepair on the second floor, 7.) Temporary arrangement described above expires on December 15, 2016 and the occupants agree to vacate the premises by this date. In addition, the BOH requires that you provide a monthly update to the office of Public Health on your progress in vacating the property on or before December 15, 2016.” John J. Flynn, J.D., seconded the motion. All were in favor. The Minutes of March 16, 2016 were approved with correction. The Emergency Preparedness report was reviewed and the following topics were discussed. The Board of was updated on the Health and Medical Coalitions, which is an effort to facilitate the merger of Region 4A and Region 4B into one Health and Medical Coordinating Coalition, (HMCC). The Board was updated on the statewide Public Health Emergency Preparedness Concurrence Conference for the Budget Period 5 Work plan. Health Education Report was reviewed and the following topics were discussed; On 2/2016 Faye Andrews, MPH, Health Educator, visited seven tobacco retailers in Lexington. She made note that almost all establishments were in compliance with the regulation. Burt Perlmutter, M.D., motioned that the meeting be adjourned and Sharon MacKenzie R.N., seconded.
