Krieger and Associate Members F. David Wells, Laura Hussong and James A. Osten Administrative Staff: David George, Zoning Administrator Address: 11 Cider Mill Lane, Map 78, Lot 114N The petitioner is requesting SPECIAL PERMIT, from Ch. 135 of the Code of the Town of Lexington (Zoning By-Law) in accordance with §135-8.4.2 and § 135-9.4, to allow modification (addition) of a nonconforming structure. The Chairman read a letter from the applicant, Jigar Patel, requesting the petition to be withdrawn without prejudice. On a motion by Jeanne K. Krieger and seconded by F. David Wells, the Board voted 5-0 to allow the applicant to withdraw their petition for a special permit without prejudice. Osten Administrative Staff: David George, Zoning Administrator Address: 52 Lowell Street, Map 20, Lot 43 The applicant was requesting Special Permit from section 135-3.0, Table 1: Schedule of Permitted Uses, Line C.1.06 and the earth fill and removal by-law, Chapter 42 of the Code of Lexington to allow approximately 500 cubic yards of fill to be brought to the property. The Chairman read a letter from the applicant, Brian Kelly, requesting the petition to be withdrawn without prejudice. On a motion by Jeanne K. Krieger and seconded by Laura Hussong, the Board voted 5-0, to allow the applicant to withdraw their petition for a special permit without prejudice. Osten Administrative Staff: David George, Zoning Administrator Address: 108 Bow Street, Map 20, Lot 106A The petitioner requested a Special Permit from Chapter 135-8-3 to allow modification of an existing non conorming 3-family dwelling. The Chairman read a letter from Attorney John Farrington representing the applicant, Frank Ponte, requesting the petition to be postponed until Thursday, February 26, 2015. On a motion by F. David Wells and seconded by Jeanne K. Krieger, the Board voted 5-0 to allow the petition to the postponed until Thursday, February 26, 2015 at 7:30 pm in the Selectmen’s Meeting Room. Osten Administrative Staff: David George, Zoning Administrator Address: 10 Franklin Road, Map 56, Lot 221 The petitioner submitted the following information with the applications: nature and justification of request; plot plan; floor plans, elevations and photographs. Prior to the hearing, the petitions and supporting data were reviewed by the Building Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Zoning Administrator, the Planning Director, Economic Development; the Historic District Commission Clerk, Historical Commission and the Zoning Administrator. Comments were received from Historical Commission and the Zoning Administrator. The petitioner requested a SPECIAL PERMIT in accordance with 135-8.4.2 and 135- 9.2 of the Zoning Bylaw to allow modification of a non conforming structure. The Chairman opened the hearing at 7:45 pm by reading the legal notices and described information received from the petitioner. Architect Colin Smith presented the application for the owners of the proprty, Alicia and Fred Criniti. They are seeking to remove the existing front steps and construct an approximately 18.0 ft. by 7.0 ft. new stone terrace with wooded 4.0 ft. by 4.5 ft. steps. At the hearing Mr. Smith presented the board with a new photograph sketch of the proposed addition, explained the modest addition and the unusal shape of the lot line and location of the home. Board members asked the applicant to clarify the lot line, questioned the parking plans and the easement area in front of their home. Board members thought the plan was very beautiful improvement to the property. Owner of the property Alicia Criniti spoke to say they had reached out to their neighbors by e-mail and received 2 positive comments in favor of the project. There were no questions from the audience. No one spoke in opposition to the petition. The Chairwoman closed the hearing at 7:50 pm. Williams, the Board voted 5-0, to grant a SPECIAL PERMIT, from Ch. 135 of the Code of the Town of Lexington (Zoning By-Law) in accordance with §135-8.4.2 and § 135-9.4, to allow modification (addition) of a nonconforming structure. Osten Administrative Staff: David George, Zoning Administrator The Board discussed the minutes of January 22, 2015 and determined they did not have a quorum of members present from the January 22nd to vote on the minutes.
