Samuel Hadley Public Services Building 2nd Floor Meeting Room 201 Bedford Street Lexington, MA 02420 Board of Health Members in Attendance: Wendy Heiger-Bernays, PhD, Chair, Sharon MacKenzie, Burt Perlmutter, MD, Jay Flynn, JD Health Division Attendees: Gerard F. Cody, Health Director, Linda Rainville, Clerk 1.) Minutes of April 1, 2015 approved with three corrections and Article III Hearing of May 5, 2015 approved with one correction 2.) Discussion and Decision on proposed revisions to Article III of the Board’s Regulations (Chapter 155 of the Code of the Town of Lexington): “Smoking in the Workplace and Youth Access Regulations. Mr. Cody explained that there was a hearing on May 5, 2015. At that meeting Cheryl Sbarro and Ken Farbstein spoke at the hearing. Mr. Cody also reported that he had received a letter from the Law Office of Duffy Law Office. Kelsey Matheson, Greater Boston Tobacco Free Commission Partner, spoke in support of the new regulation. Dr. Purlmutter motioned to accept the regulations as written to go into effect on July 1, 2015. “The Lexington Board of Health move that the Board revise Article III of the Board’s Regulations (Chapter 155 of the Code of the Town of Lexington): “Smoking in the Workplace and Youth Access Regulations, in accordance with the draft regulations dated May 20, 2015 discussed at this meeting subject to such other non-substantive changes to the numbering of and correction of typographical errors in those regulation as may be necessary.” S. MacKenzie seconded. All in favor. 3.) Community Health a.) CHNA grant update – CHNA grant funds are available through July 1st 1. Showcase at Lahey Hospital on May 14 – Mr. Cody will be presenting the “Showcase”. st 2. Community Conversation on Mental Health, June 1. – This meeting will be held at the Depot st. Center on June 1 So far we have trained approximately 60 people. b.) Community Health and Infectious Disease Report – Mr. Cody spoke to the BOH regarding the Community Health Report submitted by D. Neylon. 1. Animal Quarantine / Rabies prevention - Mr. Cody reported that there still is no Animal Control Officer, the Health Department has been responding to concerns by administrative response to any Animal Control issues. At this time there are seven animals in quarantine and one barking dog report has been handled. 3.) Environmental Health a.) Environmental Health Report b.) Food Inspection program Beijing - Ms. Frances Cheng, Manager and Ms. Maureen Lee of Food Service Solutions 1. discussed the State Sanitary Code violations. Ms. Lee has been working with Ms. Cheng since the end of December 2014. The original team of chefs has left and a new team of chefs has come aboard. Ms. Lee is working with the staff to change the work practices. In April 2015 there were quite a few violations and in May the amount of violations had decreased significantly. The owner of Beijing Restaurant must ensure that all staff complete the “Person in Charge, PIC, training with the Health Division. The food consultant must develop a cleaning schedule for Beijing Restaurant to follow on a daily and weekly basis. After much discussion: Dr. Purlmutter motioned: “The Lexington Board of Health orders that you hire a food consultant by June 17, 2015 . The food consultant will provide the services under the time line that is outlined in the Health Seconded by J. Flynn Division letter dated May 20, 2015.” 2.Lexington House of Pizza- New Owner Mohammad Alam appeared to discuss Food Plan Review for new permit and compliance with State Sanitary Code. Mr. Alam told the BOH that he will be assigning a person to accept the payments and a person to handle food. Mr. Alam stated that there was 2 hand sinks, one located near the food prep area and one in the bathroom. They do not have a “mop” sink at this time. Mr. Cody told him they could use the toilet to dump the mop water for now. Mr. Alam needs to present the BOH with a plan to install a mop sink within two to three months. There have been 2 complaints regarding lack of hair restraints and bare hand food handling. Ms. MacKenzie motioned: “The Lexington Board of Health grants an Annual Permit to Operate a Food Establishment to Lexington House of Pizza contingent upon a satisfactory food inspection report, including no critical violations. Compliance must be achieved with the food code, otherwise administrative action may be taken including but not limited to fines or an order to hire a food consultant for additional training.Seconded by B Perlmutter ” 3.Corporate Cafeteria at Ab Initio 201 Spring St. Mr. William Harden and Mr. Cliff Stratton requested a variance for the requirements of hot and cold food holding for ready to eat foods. After some discussion: Dr. Purlmutter motioned: “The Lexington Board of Health approves the variance request from the requirement of Food Code Chapter 3, section 501.16, Potentially Hazardous Food, Hot & Cold holding with the condition that the plan outlined in your memo dated May 15, 2015 is followed.” Seconded by J. Flynn c.) State Sanitary Code Case Review 1.87 Pleasant Street – Mr. Cody told the Board that he had received a request extent the deadline for compliance. The tenant informed Mr. Cody that smoke and CO detectors will be changed. Dr. Heiger Bernays motioned: “The Lexington Board of Health grants the request for an extension to continue to come into compliance from the requirements of State Sanitary Code, 105 Code of Massachusetts Regulations (CMR) 410.750 (J). This violation also constitutes a violation of the Lead Law, Massachusetts General Laws (MGL), chapter 111, section 197, and the Regulations for Lead Poisoning Prevention and Control, 105 CMR 460.000 holding with the condition that the plan outlined in your letter dated May 6, 2015 is followed.” Seconded by S. MacKenzie 2.494 Marrett Road – Mr. Cody reported that there was a leaking sewer pipe from the house to the street. The property owner had work done in November or December and the utility company struck the sewer line. The problem became apparent with the spring thaw. The DPW inspected the sewer line and concluded that it was the property owner’s responsibility. Mr. Cody send the homeowner an order to correct. d.) Pool and Spa Lifeguard variance request Dr. Heiger Bernays motioned: “The Lexington Board of Health grants the variance request from the requirement of lifeguards for the safe operation of pools as listed under 105 CMR 435.33 (1). In addition, all the requirements of 105 CMR 435.23 (2) shall be met including all signage Warning No Lifeguard on Duty which includes: “” in easy to read, legible letters which Children under age of 16 should not use swimming pool are at least four inches high “ without an adult in attendanceAdults should not swim ” and another sign that states, “ alone ”. This variance applies only to the following seasonal pool facilities, which have made the request in writing. They are listed as follows: Avalon at Lexington Hills Avalon at Lexington Ridge Aloft Pool @ Paramount Hotel Element Pool @ Paramount Hotel Peacock Farm Pool Moon Hill Pleasant Brook This variance will expire at the end of the Seasonal Pool season or upon notification of an unsafe operating condition at a specific facility.” Seconded by S.
