Lexington Board of Health Meeting, <br /> Wednesday, March 13, 2013 at 7:00 p.m. <br /> Town Office Building, Room G-15, <br /> 1625 Massachusetts Avenue, Lexington, MA <br /> Board of Health Attendees: Sharon MacKenzie, R.N. CCM, Chair; Burt M. Perlmutter, M.D., <br /> David S. Geller, M.D.; John J. Flynn, J.D. <br /> Health Department Attendees: Gerard F. Cody, Health Director; Ann Belliveau, Health <br /> Clerk/Office Manager <br /> Sharon MacKenzie called the meeting to order at 7:00 p.m. <br /> The Board reviewed the minutes of February 13, 2013. Gellar motioned to approve the minutes <br /> with corrections. Flynn seconded. All approved. <br /> Community Health Update/Report—The Board reviewed the Community Health Report for <br /> December 2012 prepared by David Neylon, R.N., and follow-ups for the four(4) communicable <br /> diseases had been done in a timely manner. Cody provided the Board with a"Lexington Healthy <br /> Communities"update. <br /> Environmental Health Report <br /> The Board reviewed the Environmental Health Report for March 2013 and the February 2013 <br /> inspections report. <br /> Upper Crust Food Establishment Permit- Shawn Shenfield, Operations Manager at the Upper <br /> Crust appeared before the Board to obtain a food establishment permit for this new facility. Mr. <br /> Shenfield explained about the various improvements recently made to the facility along. After a <br /> discussion, Perlmutter motioned that the Lexington Board of Health grants an annual permit to <br /> operate a food establishment to Upper Crust at 41 Waltham Street upon successful completion of <br /> a pre-operational inspection. MacKenzie seconded. All approved. <br /> Cafe Aroma Food Establishment Permit— Staff from Cafe Aroma appeared before the Board to <br /> describe that the Edinburg Center in Lexington has created Cafe Aroma to help with their clients <br /> training for possible advancement into their vocational program. The Dept. of Mental Health and <br /> Mass Rehab fund these programs. Both the Operations Manager and the Program Director <br /> program director have Servesafe Certifications. The facility is only open to employees of the <br /> Edinburg and not the general public. Perlmuttter motioned the Lexington Board of Health grants <br /> an annual permit to operate a food establishment to Cafe Aroma at 1040 Waltham Street upon <br /> successful completion of a pre-operatonal inspection. Geller seconded. All approved. <br /> Brookhaven Pool Variance Request— Cody advised the Board that Brookhaven at Lexington <br /> requested relief in the form of a variance from 105 CMR 435.23(1) Lifeguards. Since there have <br /> not been any reported cases of injury, or death to the Lexington Board of Health in the previous <br /> seasonal pool facility year,then it appeared that lifeguards may not be necessary for the safe use <br /> of the swimming pools or wading pools at this facility. After a discussion, Flynn motioned that <br /> the Lexington Board of Health grants the variance request from the requirement of lifeguards for <br /> the safe operation of pools as listed under 105 CMR 435.23(1)to Brookhaven at Lexington. In <br /> addition, all the requirements of 105 CMR 435.23(2) shall be met including all signage which <br /> includes: "Warning No Lifeguard on Duty"in easy to read, legible letters which are at least four <br /> inches high"Children under age 16 should not use swimming pool without an adult in <br /> attendance"and another sign that states, "Adults should not swim alone". This variance will <br /> expire at the end of the seasonal pool season or upon notification of an unsafe operating condition <br /> at a specific facility. <br /> Flynn motioned to adjourn.
