Lexington Board of Health Meeting, <br /> Wednesday, February 13, 2013 at 7:00 p.m. <br /> Town Office Building, Room G-15, <br /> 1625 Massachusetts Avenue, Lexington, MA <br /> Board of Health Attendees: Wendy Heiger-Bernays, Ph.D., Chair; Sharon MacKenzie, R.N. <br /> CCM; Burt M. Perlmutter, M.D., David S. Geller, M.D., John J. Flynn <br /> Health Department Attendees: Gerard F. Cody, Health Director <br /> Wendy Heiger-Bernays called the meeting to order at 7:00 p.m. <br /> The Board reviewed the minutes of January 9, 2013. MacKenzie motioned to approve the minutes <br /> with corrections. Perlmutter seconded. All approved. <br /> Board of State Examiners of Plumbers and Gas Fitters—Gerard Cody introduced Mark Coughlin, <br /> AIA of Strekalovsky Architecture Inc. to the Board. Mr. Coughlin appeared before the Lexington <br /> Board of Health on behalf of Urgent Care of New England Inc., pursuant to M.G.L. c. 142 § 13, <br /> to petition the Board for a variance from the State Plumbing Code. Variance is requested from <br /> Section 10.10 of the State Plumbing Code requiring one shower per each sex for Medical Health <br /> Care Buildings. The proposed use of space is an"out-patient"clinic as defined by section <br /> 304.1.1 of the 2009 International Building code. Urgent Care of New England Inc., is requesting <br /> permission to eliminate the showers for both locations. After a discussion, Perlmutter motioned <br /> that the Lexington Board of Health supports the variance request from the requirement of <br /> Sections 10.10 of the State Plumbing Code requiring one shower per each sex for Medical Health <br /> Care Buildings. The proposed use of the space is an"out patient"clinic,therefore,the shower <br /> facility would not be used. The lack of a shower fixture poses no public health risk for this <br /> facility. MacKenzie seconded. All approved. <br /> Hayden Rink Snack Bar Variance Request— Cody introduced Lynne Harris who operates the <br /> snack bar at Hayden Ice Rink. Cody stated that currently a two bay sink is in place and because <br /> the food code requires a three bay sink, Mr. Harris is requesting a variance from the requirement. <br /> After a discussion, Gellar motioned that the Lexington Board of Health approves the variance <br /> request from the requirement of Food Code Chapter 4, section 301.12, Manual Warewashing. <br /> Ms. Harris demonstrated knowledge to satisfy the requirement of Food Code Chapter 4, section <br /> 301.12(C),Alternate Manual warewashing. The lack of a three bay sink poses no public health <br /> risk for this snack bar operation. Perlmutter seconded. All approved. <br /> MA France LLC Variance Request— Cody introduced Mr. and Mrs. Francois and Cecile Attard, <br /> Owners of a new business specializing in the retail sale of cheese, ham,jams, bread and related <br /> items located at 46 Massachusetts Avenue and Kevin Maguire owner of the property. Mr. <br /> Maguire, on behalf of Francois and Cecile Attard, informed the the Board that the space was <br /> formerly occupied by a fish market and all the sinks were removed except for the restroom sinks. <br /> Due to the limited volume of food prep,the owners propose to use the bathroom hand sink for <br /> hand washing, a variance for the lack of a three bay sink and propose to use a dish washer. Cody <br /> recommended that the Attard's purchase a dishwasher with a sanitizer step. After a discussion, <br /> Jay Flynn motioned that the Lexington Board of Health approves the variance request from the <br /> requirement of Food Code Chapter 4, section 301.12, Manual warewashing and Food Code <br /> Chapter 5, 204.11 Handwashing Facilities. However, it is the recommendation of the Board of <br /> Health that this case be continued upon completion of the Food Plan review application so that a <br /> permit to operate a food establishment may be issued. MacKenzie seconded. All approved. In <br /> summarizing, Cody informed Maguire that in order to complete the food plan review,the owners <br /> must submit to Kathy Fox,the type of dishwasher with the sanitizing step that you are <br /> purchasing. The owners will then receive a letter stating the plan has been reviewed and you can <br /> begin to build out under these conditions. There will then be a preoperational inspection before <br /> opening for business. <br />
