CONSERVATION COMMISSION
MINUTES
Tuesday, May 22, 2012

Commissioners present: Stew Kennedy, Joyce Miller, Duke Bitsko, Phil Hamilton (arrived 8:20 pm),

Chair Joyce Miller opened the meeting at 7:32 pm in Room G-15 of the Town Offices Building
7:33 pm Reports
Mr. Kennedy reported that 240 feet of boardwalk were completed at Paint Mine on a
Stewards workday on May 20.
Ms. Miller reported that Jane Warren has been appointed as a new member of the
Commission.
7:36 pm Motion made and seconded to suspend the meeting until additional Commissioners
arrive to establish a quorum, 3-0 in favor.
7:41 pm Chair Joyce Miller re-opened the meeting in Room G-15 of the Town Offices Building.
7:48 pm Meeting – RDA, 470 Concord Avenue

Construct an addition to a single family home
Present for the applicant: Zoltan Jurahz, Uniterra Consulting, LLC.
Documentation: RDA application materials
Mr. Jurahz explained the proposal to construct a 1600 square foot addition to a single
family home on the site. He also explained that the paved area on the site would
increase and that an additional parking area would be constructed with pervious
pavement.
Comments from the Commission as follows:
Mr. Kennedy asked for clarification about the catwalk, filling, and the vegetated swale.
Mr. Bitsko asked for clarification about the groundwater elevations and the porous
pavers. Mr. Bitsko asked for a cut-sheet on the porous pavers. Mr.Wolk asked for
clarification about the run-off to be captured and directed to the recharge facility. The
Commission asked for more run-off to be directed to the recharge facility.
Motion made and seconded to issue a negative determination with conditions, 4-0 in
favor.
8:07 pm Cont. Hearing – NOI, 990 Waltham Street, Brookhaven at Lexington

Soil remediation related to lead impacted soils
Ms. Miller stated that the applicant withdrew the Notice of Intent filing.
8:08 pm Hearing – NOI, 94 Hartwell Ave, Ashok Patel, Hartwell Hospitality, LLC

Construct an outside patio
Present for the applicant: Jack Sullivan, Sullivan Engineering Group
Documentation: NOI application materials
Mr. Sullivan explained that the proposal to construct an outdoor patio for restaurant
seating was being modified and that he would like to solicit feedback from the
Commission for the modifications.
Ms. Mullins asked for clarification about the raising of the grade in the modified plan.
Ms. Miller commented that a previous special permit was issued to protect the trees on
the property. Mr. Wolk asked about the diameters of the trees in question and expressed
concern about the replanting of small trees. Mr. Kennedy asked for clarification about
the wetland line near the drainage basin.
Motion made and seconded to continue the hearing at the applicant’s request to June 5,
2012 at 7:30 pm, 4-0 in favor.
8:23 pm Cont. Hearing – NOI, 43 Sanderson Road, Renuka Srinivasan

Construct a bump out addition to rear of existing single family home

Documentation: none
Ms. Miller stated that the DEP number that previously held up the closing of the hearing
had been provided.
Motion made and seconded to close the hearing, 5-0 in favor.

Construct a two story addition and porch

The Commission discussed the Alternatives Analysis provided by the applicant.
Motion made and seconded to close the hearing, 5-0 in favor.
8:27 pm Cont. Hearing –NOI, Banks Avenue, Keith Dorrington

Construct a new single family dwelling
Motion made and seconded to continue the hearing to June 19, 2012 at 7:30 pm at the
applicant’s request, 5-0 in favor.
8:28 pm Discussion of compliance with enforcement order at Mal’s, Rear of 7 Massachusetts
Avenue.
Brian Timm, Meridian Associates, presented to the Commission regarding the
enforcement order. He explained that the guardrail was installed partially on Town
property and a parking area currently exists in part of the area that the enforcement order
required to be restored. Mr. Kirby, LEC Environmental, submitted a memorandum
regarding the success of the restoration where it did take place.
The Commission expressed concern that a significant portion of the area that was
required to be restored in the enforcement order has not been restored and has a parking
surface on it. The Commission asked for details regarding how much the actual restored
area differs from the amount of land that was required to be restored in the enforcement
issue. The Commission stated that guardrail would need to be moved off of Town
property and expressed interest in moving the parking surface away from the brook and
out of the restoration area. The Commission requested a site visit, a field marker
indicating the property line, and a spray painted line along the required placement of the
guardrail from the enforcement order.

Motion made and seconded to issue Order of Conditions, 5-0 in favor.
Issue Order of Condition for 71 Hancock Street (201-857, BL 815)
The Commission discussed the patio within the 25 foot buffer and the bounds on the 25
foot buffer.
Motion made and seconded to issue Order of Conditions, 5-0 in favor.
Issue Order of Condition for 43 Sanderson Road (201-860, BL 818)
Motion made and seconded to issue Order of Conditions, 5-0 in favor.
Issue Order of Condition for 28 Saddleclub Road (201-861, BL 819)
The Commission discussed the debris removal, bounding of the property line abutting
Town land, cessation of mowing on Town land, and non-approval of the wetland line.
Motion made and seconded to issue Order of Conditions, 5-0 in favor.
Accept and sign Conservation Restriction # 94, 39 Solomon Pierce Road, D. and P.
Brick.
The Commission discussed directions in the descriptive section of the restriction.
Motion made and seconded to accept Conservation Restriction # 94 with corrections as
needed by the Conservation Administrator, 5-0 in favor.
Issue Certificate of Compliance for 34 Rawson Avenue (201-743, BL 702)
Motion made and seconded to issue Certificate of Compliance, 5-0 in favor.
9:19 pm Motion made by roll call vote to enter executive session for the purposes of discussing a
real estate transaction. It is declared that an open session would have a detrimental
effect on the Town’s negotiating position. The Commission will not return to open
session at the conclusion of executive session.
