Lexington Board of Health May 11, 2005 - Meeting Minutes

Heiger-Bernays called the meeting to order at 7:05 PM. There was no public participation.
Heiger-Bernays asked the Board to review the minutes of April 13, 2005. Perlmutter moved to
accept the minutes of the April 13, 2005 as amended. MacKenzie seconded. All approved.
The Board reviewed the datasheets and asked for a 2004 Communicable Disease Report for
tracking purposes.
Fullerton began a discussion concerning the residents requests for variances from the required
septic/cesspool pumping regulation. The Board would like a special hearing for septic variances
in June, 2005. A time and date will be announced as agreeable to the Board.
Fullerton began a discussion concerning the Tobacco Compliance Program. Liz Silva and
Carolyn Pratt of the Tobacco Coalition addressed the Board concerning the compliance check
conducted on March 16, 2005. According to Carolyn Pratt, five establishments were not in
compliance. Silva expressed her concern of the number of stores not in compliance. Two of the
non-compliant establishments attended the meeting to request a hearing regarding the violation:
Michael Fuller of Minuteman Mini-Mart and Moses Avakian of Countryside Shell. After a
discussion, the Board decided to lift the fine for Minuteman Mini-Mart; however, the first
offense would stand and with the understanding that they must agree to tobacco training offered
by the coalition. The Board then decided that Countryside Shell’s fine stands because it was a
second offense. Countryside Shell must also agree to the coalition training.
Perlmutter began a discussion regarding pool permit variances from 105 CMR 435.23 (2)
requesting pool operation(s) without a lifeguard on duty for:
Peacock Farm Pool Adams Pool
Five Fields Pool Battle Green Inn
Six Moon Hill Pool Drummer Boy Condominiums
Paint Rock Pool
Perlmutter motioned to grant the variances with the provision until the pools listed above pass
their first inspection to make sure they are in compliance.
A discussion began regarding the Battle Green redevelopment status. According to the owner,
Eric Shapiro he does not plan to go ahead with development plans at this time.
Heiger-Bernays asked about the development of the Jefferson Union factory located on Fletcher
Avenue into condominiums. Fullerton informed the Board of the permit request for monitoring
wells and his request for the respective tests results when completed.
Perlmutter began a discussion regarding the chlordane investigation at 1947 Massachusetts
Avenue. Heiger-Bernays feels the Board of Health has an obligation to notify neighbors and
renters via a letter.
Heiger-Bernays motioned that the rest of the agenda be held until the next meeting. Perlmutter
seconded. All approved.
Heiger-Bernays requested a inquiry protocol concerning foodborne illness from Fullerton.
MacKenzie moved to adjourn. Thompson seconded. All approved.
