<br />Le <br />xington Board of Health, December 9, 2004, Meeting Minutes <br />Police Guard Room, 1575 Massachusetts Avenue, Lexington, MA <br /> <br />Attendees: <br /> <br />Board of Health: James Fearnside, Chair; Burt Perlmutter; Sharon MacKenzie <br /> <br />Health Department: Derek Fullerton, Kathy Fox <br /> <br />The meeting began at 7:05 PM. There was no public participation. <br /> <br />Fearnside began a discussion concerning the recommendations for consideration for the Health Director. Fearnside <br />said the Board was reminded that these discussions need to be public and the list of the Board’s recommendations <br />had been sent to Linda Vine and the Selectmen. Two candidates had been selected by the interview committee for a <br />second interview and the third person is recommended by the Board of Health. <br /> <br />Fearnside asked the Board to review the minutes of November 18, 2004. Perlmutter motioned to accept the <br />minutes. MacKenzie seconded. All approved. <br /> <br />The Board reviewed the SOG to be used by the Lexington Fire Department and the Lexington Police Department to <br />enact and uphold the Massachusetts Baby Safe Haven Law. <br /> <br />Fullerton advised the Board of the flu updates including the next senior clinic on Friday, December 17th. The State <br />has lowered the age to 65. Individuals who are between the ages of 18 and 65 who provide a physician’s order are <br />also eligible to receive the flu vaccine. First responders for the police and fire department will be eligible as well. <br /> <br />Fullerton advised the Board of the new part-time Animal Control Officer, Stephanie Doucette. <br /> <br />th <br />Fullerton mentioned that the Board was scheduled to be on the Board of Selectmen’s meeting on January 10 to <br />inform the BOS about the changes to the permit fees. The Board of Health will hold a public hearing to discuss <br />these increases on Thursday, January 13, 2005. <br /> <br />The Board reviewed the minutes of the Arlex Hearing of December 2, 2004 and suggested some additions/changes <br />to the minutes before approved. <br /> <br />Fullerton updated the Board concerning the part-time nurse applicants. Three candidates were interviewed and one <br />was offered the position. <br /> <br />The Board began a discussion concerning the housing violations at 50 Rindge Avenue which is owned by Mr. Paul <br />McMann. Fox informed the Board of Mr. Paul McMann’s request for a hearing but did not show up at the hearing. <br />Fox submitted a detailed memo concerning the inspections and violations. Perlmutter motioned to open the hearing <br />at 7:30 p.m. MacKenzie seconded. All approved. A discussion followed. Perlmutter motioned that since the unit at <br />50 Rindge is unoccupied, he may not lease that unit for occupancy until such time as all violations have been <br />corrected and verified by the inspectors. MacKenzie seconded. All approved. <br /> <br />Ethan Mascoop informed the Board that he felt there was a large amount of lead paint in the unit at 50 Rindge <br />although it had not been tested. The child living there is now 10 years old. Fearnside asked if she had been tested <br />and Mascoop stated that she was probably caught in the system. Mascoop also stated that because there are no <br />children there under the age of 6, they cannot force the landlord to remove the lead. <br /> <br />Fearnside motioned to adjourn.
