<br />Lexington Board of Health May 13, 2004 Meeting Minutes <br />Police Guard Room, 1575 Massachusetts Avenue, Lexington, Massachusetts <br /> <br />Attendees: <br /> <br />Board of Health: James Fearnside; Wendy Heiger-Bernays; Sharon MacKenzie, <br />Burt Perlmutter <br /> <br />Health Department: Derek Fullerton <br /> <br />Public: Ingrid Klimoff, James and Judith Sheehy, Robert Kerwin of Tarlow Breed, Hart <br />Murphy & Rodgers P.C., Norma Floyd, Brian Suncock and David Eagle <br /> <br />Fearnside called the meeting to order at 7:00 p.m. and recommended reviewing the <br />minutes of the March 11, 2004 meeting. <br /> <br />Perlmutter motioned to accept the minutes. MacKenzie seconded. All approved. <br /> <br />Robert Kerwin of Tarlow Breed, Hart Murphy & Rodgers addressed the Board <br />concerning Arlex Oil and asked for more than 10 minutes to express his concerns. <br />Kerwin requested a special meeting at a later date to see if a nuisance has occurred. <br />Perlmutter recommended going forth with the excessive idling hearing. <br /> <br />James Sheehy informed the Board that between 35 and 40 buses begin idling at <br />approximately 5:30 a.m. for approximately one hour. Sheehy then requested a special <br />hearing. <br /> <br />Brian Suncock informed the Board of the oil dump at Arlex every night at which time the <br />truck idles for 20 minutes, the engine cannot be turned off and restarted because that <br />would violate the noise bylaw. <br /> <br />Norma Floyd spoke of her disrupted sleep because of the noise at Arlex. <br /> <br />Judy Sheehy addressed the Board concerning a letter she received from Beverly <br />Anderson dated December 19, 2000. In the letter, Anderson said she would need to <br />speak with C&W. <br /> <br />Ingrid Klimoff advised the Board of the smell of fumes on Reed St. every morning. She <br />also read a letter sent to the Board of Selectmen from Elaine Adler, 3 Sunny Knoll <br />Terrace, Lexington. <br /> <br />David Eagle, President of Arlex Oil Corporation expressed his concern that he was told <br />there would be a 10 minute hearing on idling. Eagle also informed of a two hour seminar <br />recently held for C&W employees by a DEP representative. Eagle also informed the <br />Board that Lexington requires a temperature of 55 degrees for the children and it is stated <br />in the school bid contract. <br /> <br />The public hearing was closed at 7:40 p.m. <br /> <br />The Board decided to have a special hearing on Thursday, June 17, 2004 at 7:00 p.m. to <br />discuss the concerns expressed in the letter regarding Arlex Oil Corporation dated <br /> March 30, 2004 from Robert J. Kerwin of Tarlow Breed Hart Murphy & Rodgers. <br /> <br /> <br />
