<br />Lexington Board of Health Meeting, February 13, 2008 at 7:00 p.m. <br />Cary Hall, Ellen Stone Room <br />1605 Massachusetts Avenue, Lexington, MA <br /> <br />Attendees: Wendy Heiger-Bernays, Chair; Sharon MacKenzie; Burt Perlmutter <br /> <br />Health Department Attendees: Gerard F. Cody, Ann Belliveau <br /> <br />Heiger-Bernays called the meeting to order at 7:05 p.m. There was no public <br />participation. <br /> <br />The Board reviewed the minutes of January 9, 2008. MacKenzie motioned to accept the <br />minutes of January 9, 2008 with corrections. Perlmutter seconded. All approved. <br /> <br />The Board reviewed the Public Health Nurse report. <br /> <br />Cody advised the Board of the PHN update. The Public Health Nurse position will <br />become a full-time position and the Town of Belmont has agreed to share some of the <br />hours from Lexington in accordance with a pending agreement. Cody mentioned that <br />Carl Valente, Town Manager is putting together a funding package for this to happen. <br />The Belmont Board of Health plans to meet in April to approve this arrangement. <br /> <br />Cody informed the Board of the Medical Waste Disposal Day scheduled for Saturday, <br />April 5, 2008, from 9:00 a.m. until noon at the Lexington Town Hall back parking lot. <br />Lexington residents may bring sharps, syringes, and expired medicines. Announcements <br />will be posted in the Library, Senior Center and The Lexington Minuteman. <br /> <br />The Board discussed Shire Human Genetic Therapies’ request for an rDNA permit and a <br />variance from § 155-39 (Restrictions), (d) which states in part that the: Use of more than <br />5,000 liters of rDNA culture shall not be permitted. The variance will allow Shire to <br />exceed the 5,000 liters of rDNA culture in 2 liter bottles. The Biosafety Committee <br />recommended issuing the permit once the variance had been granted. MacKenzie <br />motioned to grant the variance to Shire. Perlmutter seconded. All approved. <br /> <br />Food Code Compliance Program Update <br /> <br />Cody introduced a representative from the Teppanyachi Restaurant since the owner, Li <br />Fei Chen was out of town. Cody explained that this meeting is a way for the new <br />establishments to meet the Board. Cody mentioned that a recent inspection at <br />Teppanyachi had 5 critical violations and several non-critical violations. Cody will make <br />sure this establishment is in compliance and will make sure a serve-safe person is on duty <br />at all times. This issue will be continued at the next meeting when the owner of the <br />establishment is available. <br /> <br />Cody proposed to the Board adding the following to Article XIII, Food Establishments <br />Regulation, § 155.96.1. Requirements for Persons in Charge, (PIC): <br /> <br />D. The Board of Health or its agents may require additional PIC training <br /> for establishments which have a Person in Charge who fails to demonstrate <br /> knowledge of foodborne illness prevention, Hazard Analysis Critical Control <br /> Points and the requirements of 105 CMR 590.003(B) and CMR 590.003(A) <br /> (1-6). The Person in Charge training will be provided by the Health <br /> Department at the Town Hall during scheduled appointment times. Due to <br /> non-compliance, the fee for this Department Mandated Food, (PIC Training) <br /> Seminar is One Hundred ($100.00) dollars per establishment. <br /> <br />
