The relief sought is for a special permit in accordance with section 135 -78D of the Zoning By-
law (Ch. 135 of the Code of the Town of Lexington) to allow one temporary sign.
The Chairman opened the hearing at 7:30 PM by reading the legal notices and described
information received from the petitioner relative to the petitions.
Prior to the hearing, the petition and supporting data were reviewed by the Building
Commissioner, Conservation Administrator, Town Engineer, Health Agent, Board of Selectmen,
Zoning Administrator, Planning Board and the Historic District Commission. Comments were
received from both the Zoning Administrator and Historic District's Commission.
Kajal K. Saini presented the petition on behalf of the business, Nikki's Liquors. Mr. Saini
indicated to the Board that due to the ongoing construction of the adjacent Lexington Common's,
there is uncertainty by customers, whether his business is open. Mr. Saini explained that the
temporary sign adjacent to the construction would help avoid confusion regarding whether the
business is still open.
The Board asked Mr. Saini what type of vinyl sign he proposed. Mr. Saini stated the sign would
be fixed to the wall and be the dimensions and type of sign as shown on the plan. The Board
asked Mr. Saini if he considered installing a metal sign. Mr. Saini received approval from the
Historic District's Commission to install either a vinyl or metal sign. Mr. Saini indicated that he
may install a metal sign instead. The Board asked Mr. Saini how long he felt he needed the
temporary sign. Mr. Saini indicated that he would need the sign for between 6 and 7 months.
There were no questions from the audience.
No one spoke in favor or opposition to the petition.
The Chairman closed the hearing at 7:38 PM.
The Board felt the temporary signage was appropriate for the location. The current construction,
including the redirected sidewalk access, obscures the entrance to the business and may lead to
confusion of whether the business is still open.

On a motion by Carolyn C. Wilson and seconded by John J. McWeeney, the Board vote 5 -0 to
grant the special permit for temporary signage, leaving the choice of a vinyl or metal sign to the
applicant and subject to the following condition:
The temporary sign may be installed for no longer than one year and will be both constructed
and located on the exterior wall per plans submitted with Zoning Board of Appeals application.
Other business
On a motion duly made and seconded the minutes from the January 24, 2008 meeting, for the
following hearings were approved: 45 Hartwell Avenue, 25 Hartwell Avenue, 17 Theresa
Avenue, 110 Spring Street, and 440 Bedford Street.
The meeting was adjourned at 7:50 PM.
