BOA Meeting October 27, 2011 4 <br /> <br />Minutes of the Lexington Zoning Board of Appeals <br />Selectmen’s Meeting Room, Lexington Town Hall <br />October 27, 2011 <br /> <br />Board Members Present: Chairman – Carolyn C. Wilson, John J. McWeeney, David G. <br />Williams, Martha C. Wood and Associate Member Nancy M. Adler <br /> <br />Staff Present: Dianne Cornaro, Administrative Clerk and David George, Zoning Administrator <br /> <br />Petition Address: 158 Massachusetts Avenue, Map 13, Lot 97 <br /> <br />Petitioner submitted the following with the application for hearing: nature and justification of <br />request; topographic plan; plot plan; elevations and floor plans <br /> <br />Prior to the hearing, the petition and supporting data were reviewed by the Building <br />Commissioner, Conservation Administrator, Town Engineer, Health Director, Board of <br />Selectmen, the Zoning Administrator, the Planning Director and the Historic Districts <br />Commission Clerk. Comments were received from the Building Commissioner, Conservation <br />the Health Director and the Zoning Administrator. <br /> <br />The Chairman opened the hearing at 7:37 pm by reading the legal notice and described <br />information received from the petitioner relative to the petition. <br /> <br />Attorney Edmund Grant presented the petition for the owners of the property, Eugene and <br />Jeanne Luongo. Builder Bob Phelan was also there to answer questions. <br /> <br />The applicant is requesting the following relief: 1) VARIANCE in accordance with the Zoning <br />By-Law (Chapter 135 of the Code of Lexington) section 135-35C and Table 2, Schedule of <br />Dimensional Controls to allow a rear yard setback of .6 ft from instead of the required 15 ft rear <br />yard setback; 2) VARIANCE from section 135-32 C (1) for increase in gross floor area from <br />2,355 sq ft to 3,869 sq ft; and 3) SPECIAL PERMIT from section 135-32C for reconstruction <br />of a non conforming building at 158 Massachusetts Avenue. <br /> <br />Attorney Grant went over the plans to demolish and reconstruct the 2-family structure. <br /> <br />Bob Phelan explained to the Board the cost of rebuilding a new house and the reasons it is not <br />feasible to renovate the existing structure. <br /> <br />A Board member questioned the assessor’s district information. David George the Zoning <br />Administrator used 2 different sources of information to verify the district split. <br /> <br />Other Board members asked the applicant to clarify the frontage access for parking; asked them <br />the comparison of the height from the old to the new structure and how the run-off would be <br />addressed. <br /> <br />There were no audience questions. <br /> <br />No one spoke in favor or in opposition to the petition. <br /> <br /> <br />
