Adams. <br /> VOTED: That the Town hereby ratifies, confirms and <br /> adopts the action of the Board of Selectmen in accepting r7' <br /> on behalf of the Town a gift from the Lexington Junior <br /> Chamber of Commerce of a warming hut erected on land <br /> adjacent to the old Lexington Reservoir, so called, off <br /> Marrett Road, which land is owned by the Town. <br /> Carried Unanimously 9:15 P. M. <br /> Article 4. Presented by Alan G. Adams. <br /> VOTED: That the Board of Fire Commissioners be and they <br /> hereby are authorized to relocate the fire alarm system <br /> wires at the Grove Street crossing over Route 128 to the <br /> extent deemed necessary as a result of the reconstruction <br /> of Route 128 by the Commonwealth, and to enter into a <br /> contract with the Commonwealth oMassachusetts represented <br /> by its Department of Public Works for reimbursement to <br /> the Town by the Commonwealth of the cost of such re- <br /> location; and that the sum of $490.00 be appropriated <br /> therefor and be raised in the current tax levy. <br /> Carried Unanimously 9:16 P. M. <br /> Article 5. VOTED: That the Town Celebrations Committee be and <br /> hereby is authorized on behalf of the Town to plan, provide <br /> Presented for and conduct a celebration of the two hundred and <br /> by fiftieth anniversary of the incorporation of the Town of <br /> Alan G. Lexington, and to publish the proceedings thereof; and <br /> Adams. that the sum of $3,165.00 be appropriated therefor and <br /> be raised in the current tax levy. <br /> Carried Unanimously 9:17 P. M. <br /> Article 6. Presented by Alan G. Adams. <br /> VOTED: To amend the General By-Laws by adding two new <br /> sections under Article XXVI, Miscellaneous, to read as <br /> follows: <br /> Section 2. The owner or owners of land which has been <br /> excavated shall, within five days after such owner or <br /> owners shall have been notified in writing by the Board <br /> of Selectmen that in the opinion of the Board of Selectmen <br /> such excavation constitutes a hazard to public safety, <br /> erect barriers or take other suitable measures adequate to <br /> eliminate such hazard. Whoever violates this section <br /> shall pay for each offense a penalty of not less than <br /> one hundred dollars nor more than two hundred dollars. <br /> Section 3. The owner or owners of land whereon is <br /> located an abandoned well or a well in use shall either <br /> provide a covering for such well capable of sustaining a <br /> weight ofthreehundred pounds or shall fill such well to <br /> the level of the ground. Whoever violates this section <br /> shall pay for each offense a penalty of not less than one <br /> hundred dollars nor more than five hundred dollars. <br /> Carried Unanimously 9:17 P. M. <br /> Article 7. Presented by Robert E. Meyer. <br /> VOTED: That the Selectmen be and hereby are authorized <br /> to abandon the twenty foot drain easement situated in lot <br /> 4 on Land Court Plan 15874' and the easements for sewer, <br /> water and drain purposes in that portion of the turnaround <br /> at the southerly end of Forbes Road as shown on said plan <br /> which is not incuded in Forbes Road as shown on Land <br /> Court Plan 15874'6, all of which easements are no longer <br /> required by the Town, said easements having been granted <br /> to the Town by Russell N. Cox, R. John Griefen and John J. <br /> Hammond, Trustees of Lexington Office Center Trust, by <br /> instrument dated March 30, 1962 and referred to in Land <br /> Court Certificate of Title 107665 registered in Middlesex <br /> South District Land Registry, Book 668, Page 115, that the <br /> minimum amount to be paid for such abandonment shall be <br /> $1.00; and that the instrument of abandonment shall be in <br /> such form as the Selectmen, by the execution thereof, shall <br /> approve. <br /> Carried Unanimously 9:20 P.
