Outdoor Swimming Pool Inspection Program – Variance Request – Cody advised the <br />Board of the following season pool facilities requesting relief in the form of a variance <br />from 105 CMR 435.23(1) Lifeguards: <br /> <br /> Brookhaven at Lexington Moon Hill Community Pool <br /> Drummer Boy Green Condominiums Quality Inn & Suites <br /> Adam’s Pool Five Fields Pool <br /> Pleasant Brook Pool Association <br /> <br />Cody informed the Board that 105 CMR 435.23(1) Lifeguards states in part that “the <br />operator shall provide one or more lifeguards 16 years of age or older if the Board of <br />Health determines that they are necessary for the safe use of the swimming or wading <br />pool.” Cody asked the Board to review the written variance requests. Perlmutter <br />motioned that “The Lexington Board of Health grants the variance requests from the <br />requirement of lifeguards for the safe operation of pools as listed under 105 CMR <br />435.23(1). In addition, all the requirements of 105 CMR 435.23(2) shall be met <br />including all signage which includes: “Warning No Lifeguard on Duty” in easy to read <br />legible letters which are at least four inches high “Children under age 16 should not use <br />swimming pool without an adult in attendance” and another sign that states, “Adults <br />should not swim alone”. This variance applies only to the following seasonal pool <br />facilities, which have made the request in writing. They are listed as follows: <br /> Brookhaven at Lexington Moon Hill Community Pool <br /> Drummer Boy Green Condominiums Quality Inn & Suites <br /> Adam’s Pool Five Fields Pool <br /> Pleasant Brook Pool Association <br /> <br />This variance will expire at the end of the seasonal pool season or upon notification of an <br />unsafe operating condition at a specific facility.” Heiger-Bernays seconded. All <br />approved. <br /> <br />Cody informed the Board of a upcoming informational presentation on H1N1 Influenza <br />with Judith Chevarley, Health Educator with the Massachusetts Department of Public <br />Health to be held on Tuesday, June 30, 2009, at 2 p.m. in Cary Hall. All MRC personnel <br />and camp directors have been invited to attend. <br /> <br />The Board reviewed the Environmental Health/Open Cases report along with the <br />Communicable Health Report. <br /> <br />Perlmutter motioned to adjourn.
