BOA Meeting, December 10, 2009 <br /> Minutes of the Lexington Zoning Board of Appeals <br /> Selectmen's Meeting Room, Lexington Town Hall <br /> December 10, 2009 <br /> Board Members Present: Chairman Nyles N. Barnert, John J. McWeeney, Arthur C. <br /> Smith, Carolyn C. Wilson and Martha C. Wood <br /> Staff Present: Dianne L. Cornaro, Administrative Clerk and David L. George, Zoning <br /> Administrator <br /> Petition Address: 24 Muzzey Street, Map 49, Lot 45 <br /> Prior to the hearing, the petition and supporting data were reviewed by the Building <br /> Commissioner, Conservation Administrator, Town Engineer, Health Director, Board of <br /> Selectmen, the Zoning Administrator, the Planning Administrator and the Historic <br /> Districts Commission Clerk. Comments were received from the Zoning Administrator. <br /> The Chairman opened the hearing at 8:53 pm by reading the legal notice and described <br /> information received from the petitioner relative to the petition. <br /> Tracy Patterson, DMD, MSD, owner of the business, presented the petition. <br /> The applicant is requesting a special permit to allow a free standing non - illuminated sign. <br /> A Board member asked if the property was residentially zoned. The use is allowed for <br /> offices. <br /> The Board discussed the height of the sign with the applicant. She would like the sign to <br /> start at 18 inches off the ground and agreed that the overall height would not exceed 4 <br /> feet. <br /> A Board member asked if she had considered putting the sign on the building. She is <br /> looking for the sign to help guide her patients to the driveway. <br /> There were no questions from the audience. <br /> No one spoke in favor or in opposition to the petition. <br /> The hearing was closed at 9:01 pm. <br /> On a motion by Carolyn C. Wilson and seconded by Martha C. Wood, the Board voted 5- <br /> 0 to GRANT the special permit from the Code of the Town of Lexington (Zoning By- <br /> Law) in accordance with section 135 -78 D and section 135 -11 to allow a free standing <br /> non - illuminated sign at 24 Muzzey Street with the following conditions: <br /> 1. Sign shall be 2 ft wide by 2 ft 9 inches high. <br /> 2. The height of the sign with posts shall not exceed 4 ft. <br /> 3.
