He stated <br />that it is a question of whether we should have this bit of standard for <br />the police and the people using it or whether we should allow the language <br />to outstrip the prohibitiveness of the practice and having the people using +�•rMr <br />it for the simple and permissible uses feel. that they could be "thrown off�t <br />if the policeman felt that it warranted it. <br />Mr, Polio commended the Co for extending the provisions of <br />Article XXX to include the addition as well as removal of loam, sand and <br />gravel. He recommended that the specified amount of 25 cu. yds be deleted <br />as it would treat difficulties for the Town in terms of enforcement and <br />shifting the burden of proof. He stated that as the law now stands, any <br />removal of loan, sand and gravel is in violation without a permit from the <br />Board of Appeals. <br />Mr. Newman explained that the 25 cu, yd, figure was suggested by <br />C liff Prentiss. He said the Committee was looking for some f igure that <br />would probably comply with reality because people won go to the Town if <br />they are doing a minimal job. <br />Mr. Politi suggested that the proposed amendment to Article XX , <br />Section 12 also include the wording "impedes the safety of pedestrian <br />traffic". <br />Mr. Newman, will present the suggestion to the Committee, <br />M r. Politi suggested that the amendment shifting the authority for <br />accepting and receiving on behalf of the Town equipment, supplies etc.. <br />to the Town Manager under Article XIX remain with the Board of Selectmen. <br />Mr. Politi also questioned the necessity of a Civil Defense Advisory <br />Council at the citizen level. He felt that the Manager could establish an <br />internal committee mechanism including various department heads, including <br />police, fire, dept. of public works etc. He stated that if the Council <br />were to remain he would object to the mandatory membership as suggested a <br />in the revision. He would rather see the Board retain the option as to <br />who will sit on the committee and not require it as a by -law. <br />Mr. Newman commented that the Committee felt that in the event of <br />a civil disaster, the Town would have to act quickly and they felt that <br />the more executive, the better the town's position would be rather than <br />having to have the Selectmen to make a decision, the Manager would be <br />able to, <br />Mr. Politi suggested that references by the Committee to the Select - <br />men /Town Manager Act be eliminated. He stated that it would be impossible <br />to incorporate all references to the Act and rather than do a few, it <br />would be better to leave all of them out. The Committee will check with <br />Town Counsel. <br />M r. Newman referenced Mr. Cohen 's letter of February 16 to the <br />Committee and Mr. Cohen explained his suggestions. <br />The Committee will meet again to go over the charges and Mr. Cohen <br />advised that a revised report be filed with the Town Clerk. <br />Mr. Crain thanked the Committee for the time and effort expended in <br />reviewing and making suggested changes in the B and they retired <br />from the meeting. <br />Mr. Politi and Mrs. Battin are to work together to review the pro- <br />cedures relating to the use of the Battle Green after Town Meeting. <br />
