Frick moved that Article 44 be taken from the table. <br /> Carried Unanimously. 8:34 P. M. <br /> Article 44. Presented by Manfred P. Friedman. <br /> MOTION: That the Conservation Commission be authorized to purchase <br /> (Motion or otherwise acquire, and the Selectmen be authorized to take by <br /> eminent domain, upon the written request of the Conservation Commission, <br /> as for conservation purposes including outdoor recreation as provided by <br /> Section 8C of Chapter 40 of the General Laws, any fee, easement or <br /> Adopted) conservation restriction as defined in Section 31 of Chapter 184 <br /> of the General Laws or other interest in all or any part of land <br /> shown as Lot 124 on Assessors' Property Map 34, now or formerly of <br /> (See Napoli and described in Document No. 219459, filed with Certificate <br /> Page of Title No. 63697 in Middlesex South Land Registry, Book 425, Page <br /> 31.) 581; that the sum of $205,000. be appropriated for such land acquisition, <br /> and that such amount be transferred from the appropriation voted under <br /> Article 40 of this Warrant. <br /> 8:35 P. M. <br /> Allan F. Kenney stated that with the exception of one member that is <br /> abstaining, the Board of Selectmen unanimously opposed passage of <br /> this article. 8:55 P. M. <br /> Eric T. Clarke, Chairman of the Planning Board, stated that his board <br /> is in favor of passage of this article. <br /> 8:56 P. M. <br /> Edward E. Furash stated that the Appropriation Committee is upset at <br /> paying such a high price and would like to have it sent back for <br /> negotiations. 9:08 P. M. <br /> Joseph O. Rooney moved the previous question which was declared <br /> lost by voice vote. 9 :08 P. M. <br /> Joan P. Crothers moved that action under this article be taken by the <br /> by -law as stated in Article V, Section 30 (b). M. <br /> Selectman Howard M. Kassler, former Chairman of the Conservation <br /> Commission, stated that he was backing the rest of the Selectmen in <br /> opposition to this article. He would recommend appropriating <br /> $125,000.00 and leaving out the most expensive house lots. 9:25 P.M. <br />
