<br /> parcel of land on Webb Street now or formerly of Helen I. Pinard,
<br /> being shown on a plan entitled "Plan of Land Webb Street Lexington,
<br /> Mass." dated June 3, 1968, made by William J. Skane, Registered Land
<br /> Surveyor, filed as Land Court Plan No. 35798A in the Land Reg-
<br /> istration Office; that the sum of $60,000.00 be appropriated for
<br /> such land acquisition, and that such amount be transferred from
<br /> the appropriation voted under Article 40 of this warrant.

<br /> Commission, to present this article.
<br /> After general discussion, motion, as presented by Mrs. Frick,

<br /> MOTION: That the Conservation Commission be authorized to purchase
<br /> or otherwise acquire, and the Selectmen be authorized to take by
<br /> eminent domain, upon the written request of the Conservation
<br /> Commission, for conservation purposes including outdoor recreation
<br /> (See as provided by Section 8C of Chapter 40 of the General Laws, any
<br /> Page fee, easement or conservation restriction as defined in Section 31
<br /> 55.) of Chapter 1.84 of the General Laws or other interest in all or any
<br /> part of land shown as a parcel of land consisting of lots 25 through
<br /> 29 inclusive and lot 36 of Block 19, lots l through 35 inclusive of
<br /> Block 20, :Lots 1 through 16 inclusive and lots 19 through 33 in-
<br /> elusive of Block 21, lots 1 through 15 and lots 18 through 31 in-
<br /> clusive of Block 22, lots 1 through 14 and lots 17 through 30 in-

<br /> of Deeds, Plan Book 77, Plan 24; that the sum of $5,000.00 be
<br /> appropriated for such land acquisition, and that such amount be
<br /> raised in the tax levy.

<br /> Eric T. Clarke, Chairman of the Planning Board, spoke in opposition
<br /> to this motion. 9:25 P. M.
<br /> Aalan F. Kenney stated that the Board of Selectmen are unanimously
<br /> opposed to this article as it is not needed this year. This area
<br /> is needed for a connector if it is ever built.
<br /> 9:25 P. M.
<br /> In answer to a question raised by William T. Spencer, Norman P.
<br /> Cohen, Town Counsel, stated that, in his opinion, that the state
<br /> could take this land even if it had been taken for conservation
<br /> purposes. 9:28 P. M.
<br /> Robert A. Bowyer moved that this article be referred,'to the Con-
<br /> servation Commission, Planning Board and the Board of Selectmen and
<br /> report to the next Annual Town Meeting.
<br /> 9:29 P. M.
<br /> Edward E. Furash, Chairman of the Appropriation Committee, spoke in
<br /> favor of Mr. Bowyer's amendment.
