203 <br /> (Annual Town Meeting, CONT. - APRIL 8, 1996) <br /> ARTICLE 37 MUNICIPALIZATION OF UTILITIES <br /> MOTION: That the Town Manager, with the approval of the <br /> Board of Selectmen, be authorized to take all <br /> necessary and appropriate action to establish <br /> and to maintain, in accordance with the <br /> provisions of Chapter 164 of the General Laws <br /> as amended from time to time and in accordance <br /> with rules, regulations and orders of the <br /> Department of Public Utilities as implemented <br /> from time to time, a municipal lighting and gas <br /> plant and to acquire such property and/or such <br /> rights to use or share in the use of property Passed - <br /> owned by others as may be necessary, See below <br /> appropriate or convenient for such municipal <br /> lighting and gas plant to provide aggregated <br /> retail electric and gas service by purchase and <br /> re-sale to, or- as agent for, all or such part <br /> of the persons and entities resident within the <br /> limits of the Town of Lexington which do not <br /> choose to take service from others, all in the <br /> manner and subject to the conditions which the <br /> Town Manager with the approval of the Board of <br /> Selectmen may deem appropriate under the <br /> circumstances and consistent with the rules, <br /> regulations and orders of the Department of <br /> Public Utilities. <br /> 9: 15 p.m. Presented by Selectman Eddison who stated <br /> unanimous approval of the Board. <br /> 9:20 p.m. George Woodbury, DPW, presented information on <br /> the motion and replied to questions. Mr. Woodbury stated <br /> that the provisions of the law appeared to require two <br /> votes from Town Meeting, that savings of 10-15% would be <br /> anticipated, and hopefully there would not be costs <br /> involving in pursuing minicipalization. <br /> 9:42 p.m. Paul LaPointe, Appropriation Committee, stated <br /> approval of the Committee. <br /> 9:47 p.m. The Moderator called for a standing vote which <br /> was tallied as follows: <br /> Precinct Yes No Abstain <br /> 1 17 0 <br /> 2 18 0 <br /> 3 17 0 <br /> 4 16 0 <br /> 5 18 0 <br /> 6 17 0 <br /> 7 18 1 <br /> 8 19 0 <br /> 9 17 1 <br /> At large 21 0 <br /> Totals 178 2 <br /> 9:52 p.m. The Moderator declared adoption of the motion. <br />
