23Z <br /> Article 29 5 <br /> Section 9. Residential Developments <br /> 9.3.4.4 ACCESSORY PARKING OR STRUCTURES <br /> A maximum of 20 percent of common open space may be devoted to parking or structures used for, or <br /> accessory to,active outdoor recreation provided such parking or structures are consistent with the open space <br /> uses of such land. <br /> 9.3.5 USABLE OPEN SPACE <br /> 9.3.5.1 PURPOSE <br /> Usable open space is intended to provide outdoor space for the recreational and leisure time use of,and in <br /> close proximity to,the occupants of dwelling units in a residential development with three or more dwelling <br /> units. <br /> 9.3.5.2 AMOUNT OF USABLE OPEN SPACE REQUIRED <br /> The minimum amount of usable open space provided shall be as set forth in the schedule in subsection 9.2.7. <br /> 9.3.5.3 QUALIFYING USABLE OPEN SPACE <br /> To qualify as usable open space, an area shall conform to the following standards: <br /> a. USABILITY <br /> The area must have-a surface that is adequately drained,and permits recreational or leisure time use. <br /> Such surface may include any combination of grass,plant materials,wood,or paving materials of a type <br /> designed for pedestrian or recreational use. No open space shall be considered usable if: <br /> 1) the slope of the finished grade is more than 10 percent,or <br /> 2) the land does not meet the requirements for developable site area as that term is defined in <br /> paragraph 7.9.1. <br /> b. LOCATION <br /> The nearest part of the area shall be not more than 300 feet walking distance from the dwelling unit <br /> it serves. Usable open space may be located in an area which: <br /> 1) is on a privately owned lot,or a space designated for the exclusive use of one dwelling unit, or <br /> 2) qualifies as common open space as provided in paragraph 9.3.4. <br /> c. SIZE AND SHAPE <br /> It has a minimum horizontal area of 600 square feet and no dimension is less than 20 feet. <br /> d. STRUCTURES AND FACILITIES <br /> It shall be open to the sky,and may include unroofed facilities such as a tennis court,swimming pool <br /> or similar open air recreational facilities. Accessory structures related to such unroofed facilities may <br /> be located within the area. <br /> e. ACCESS <br /> The access to usable open space shall conform to the same standards set forth in a. above,but may <br /> have dimensions smaller than those set forth in c. above. If the dimensions of the access are smaller <br /> than those required in c. above, the access shall not be counted toward the minimum usable open <br /> space required in 9.2.7. <br /> 9.3.5.4 RELATIONSHIP BETWEEN USABLE AND COMMON OPEN SPACE <br /> Common open space will qualify as usable open space provided it meets the criteria set forth in paragraph <br /> 9.3.5.3. Usable open space will qualify as common open space provided it is not on a privately owned lot,or <br /> on a space designated for the exclusive use of one dwelling unit. <br />
