211 <br /> (ADJOURNED SESSION, A.T.M. , CONT. - APRIL 10, 1996) <br /> that complies with all applicable requirements <br /> of this By-Law and the Development <br /> Regulations; or,"; <br /> 3) by adding a new paragraph at the end of subsection <br /> 7.4.5, as follows: <br /> "In granting such special permit, the Planning <br /> Board may include conditions on the minimum yard <br /> setback, and the size and location of dwellings <br /> within the subdivision." ; <br /> 4) by adding another new paragraph at the end of <br /> subsection 7.4.5, as follows: <br /> "In granting such special permit, the Planning <br /> Board may also act as the special permit granting <br /> authority and grant a special permit to allow a <br /> driveway to serve two lots as provided in <br /> subparagraph 11.8.c."; <br /> 5) in subparagraph 11.8.c. , that deals with the <br /> location of driveways, in the second sentence, by <br /> striking out the words: " . . . planned residential <br /> • development . . ." and by inserting in place thereof <br /> the word: " . . . subdivision . . ." and after the <br /> words ". . . special permit with site plan review <br /> (SPS) . . ." by adding the words: ". . . . or a special <br /> permit, as provided in subsection 7.4.5, Frontage <br /> Reduction, Lots in a Small Subdivision . . . . <br /> so <br /> that the sentence, as amended, will read: <br /> "Where the driveway is located in a <br /> subdivision for which a special permit with <br /> site plan review (SPS) or a special permit, as <br /> provided in subsection 7.4.5, Frontage <br /> Reduction, Lots in a Small Subdivision, is <br /> required and the Planning Board is the SPGA, <br /> the Planning Board may grant the special <br /> permit for the driveway location." <br /> Mr. Davies offered the following amendment: <br /> That the motion be amended in part 3) <br /> by striking out the word"on" in the first line and <br /> by inserting in place thereof the words "that <br /> increase" so that the clause as amended will read <br /> . . .the Planning Board may include conditions <br /> that increase the minimum yard setback, . . ." <br /> and by adding the word "on" between "and" and "the <br /> size" <br /> There were questions and responses. <br /> Following a voice vote at 10:09 p.m. , the Moderator <br /> declared unanimous adoption of the amendment. <br />
