ADJOURNED SESSION OF THE 1982 ANNUAL 'TOWN MEETING � r <br /> MAY 5, 1982 <br /> The meeting was called to order by the Moderator, Lincoln P. Cole, Jr, at <br /> 8 P.M. in Cary Memorial Hall and immediately recessed subject to the call of <br /> the Chair. The meeting was reconvened at 8:07 P.M. <br /> There were 181 Town Meeting Members present. <br /> The invocation was offered by Reverend John P. Streit of the Church of Our <br /> Redeemer. 8:09 P.M. <br /> i <br /> The Moderator stated that the meeting is open on Frank Sandy's motion <br /> (offered at the May 3, 1982 Session - See Page 135) that Article 60 be taken <br /> up at this time. 8:10 P.M. <br /> Mr. Sandy's motion that Article 60 be taken up at this time was adopted <br /> unanimously. 8:10 P.M. <br /> Article 60. REZONE TO CD, MARRETT ROAD <br /> AT LINCOLN STREET <br /> Presented by Peter C. J. Kelley. <br /> (Not MOTION: That the Town amend the Zoning By -Law and Zoning Map by <br /> adopted) rezoning to CD, Controlled Commercial and Industrial, the land <br /> bounded and described as set forth in this article. The preliminary <br /> site development and use plan for such zoning district shall be the <br /> plan dated April 30, 1982 filed with the town clerk. <br /> 8:12 P.M. <br /> At the start of his explanation, Peter C. J. Kelley said that he <br /> and Richard F. Perry would abstain from voting on this article. <br /> Later in the course of the discussion, before the final vote was <br /> taken, Richard M. Perry stated that he believed in the Code of <br /> Ethics set up for Town Meeting Members and, that his son was one <br /> of the proponents of this article, he also would abstain from <br /> voting on Article 60. <br /> Mr. Kelley gave a lengthy explanation, being recognized for the <br /> second ten minutes by the Moderator, and showed slides of the Five <br /> Forks Area from all angles. He showed the various businesses in <br /> the immediate vicinity to back up his position that this would be <br /> a business being put up in a business area although it abuts a <br /> residential area. At the present time a stockade fence has been <br /> erected around the property shielding it from the abutting <br /> residences. Mr. Kelley asked that Jacquelyn Olson, Landscape <br /> Architect, be recognized. She showed slides and explained the <br /> landscaping plan. There would be shrubs in the front with complete <br /> screening by the planting of hemlocks. Parking would be in the <br /> rear and screened from the neighbors by the fence. Also, she <br /> added that there would be handicapped parking. 8:32 P.M. <br /> in <br /> Mr. Kelley explained that /the Traffic Engineer's Report, this was <br /> described as a small development with no adverse effect on traffic <br /> in the area. 8:34 P.M. <br /> Jacquelyn R. Smith filed the Majority and Minority Reports of the <br /> Planning Board. 8:35 P.M. <br /> Mrs. Smith, explaining that this was a low accident corner, said <br /> that there would be traffic improvements to the intersection, at <br /> the proponents' expense, in conjunction with the Town. The pro- <br /> ponents will assume the costs for engineering work on the improve- <br /> ments and for the widening and reconstruction of the west side of <br /> Marrett Road in front of their property. They will contribute up <br /> to $5,000 for the restoration and beautification of the traffic <br /> islands at the Lincoln Street - Marrett Road - School Street inter- <br /> section opposite from their property. She went on to highlight the <br /> Planning Board Report listing the many reasons for the support of <br /> the majority of the members. 8:49 P.M. <br />
