TOWN WARRANT <br /> Town of Lexington <br /> <br /> Special Town Meeting 2020-1 <br /> <br /> <br /> Commonwealth of Massachusetts Middlesex, ss. <br /> To any of the Constables of the Town of Lexington Greetings: <br /> In the name of the Commonwealth of Massachusetts,you are hereby directed to notify the inhabitants of the Town of <br /> Lexington qualified to vote in elections and in Town affairs to meet in the Margery Milne Battin Hall in Cary Memorial <br /> Building, 1605 Massachusetts Avenue, in said Town on Monday, June 1, 2020 at 7:30 p.m., at which time and place <br /> the following article to be acted upon and determined exclusively by the Town Meeting Members in accordance with <br /> Chapter 215 of the Acts of 1929, as amended, and subject to the referendum provided for by Section eight of said <br /> Chapter, as amended. Please note that the location of this meeting is subject to change,pursuant to G.L. <br /> c. 39, § 10A, and may be held electronically if a physical meeting is not possible for health and safety reasons. <br /> ARTICLE 1 <br /> To see if the town will vote to authorize the Select Board to petition the Massachusetts General Court for <br /> legislation providing that notwithstanding the provisions of any general or special law or by-law to the <br /> contrary, all acts and proceedings taken by the town at an annual or special town meeting held by remote <br /> participation by electronic means between March 23 and September 30, 2020, and all actions taken <br /> pursuant thereto, are ratified, validated and confirmed to the same extent as if the said annual or special <br /> town meeting had been held in full compliance with any applicable general or special law or by-law; and <br /> further to authorize the Select Board to approve amendments to said act before its enactment by the General <br /> Court that are within the scope of the general objectives of the petition; or act in any other manner in <br /> relation thereto. <br /> (Inserted by the Select Board) <br /> DESCRIPTION: This article would authorize the Select Board to petition the General Court for special <br /> legislation that would confirm the validity of any actions taken at a Town Meeting being held remotely <br /> instead of in person. While the Town has worked with Representative Ciccolo and the other 33 Towns with <br /> Representative Town Meeting, we are not sure whether that legislation will be adopted at the time of our <br /> Town Meeting and this article would provide an additional opportunity to ensure the validity of actions <br /> taken at the 2020 Lexington Annual Town Meeting. <br /> And you are directed to serve this warrant not less than fourteen days at least before the time of said meeting, as provided in the <br /> Bylaws of the Town. Hereof fail not and make due return of this warrant, with your doings thereon, to the Town Clerk, on or <br /> before the time of said meeting. <br /> Given under our hands this 27th day of April, 2020. <br /> Douglas M.
