Assistant 6:30 pm New Business/Pendine Matters Request for Certificate of Compliance: 2 Diana Lane (formerly 0 Diana Ln) DEP 201-1104 BL 1062 The request for certificate of compliance for 2 Diana Lane is not ready. Request to Extend an Order of Conditions: Rangeway Extension DEP 201-968 BL 926 (from 2/15/2020 until 2/15/2021) On a motion by Ms. Dohan and seconded by Ms. Ladd, the Commission voted 6-0 to extend the order of conditions by one year. Request for Plan Modification: 288 Concord Avenue DEP 201-1045 BL 1002 Mr. Dave Crossman, wetland scientist for the project presented before the Commission. The applicant had removed four large trees on the property. The applicant proposes to plant four native trees to replace those that were removed. On a motion by Ms. Samuels and seconded by Ms. Ladd, the Commission voted 6-0 to approve the plan modification pending receipt of tree species details. Ratify Enforcement Order: 39 Woodpark Circle On a motion by Ms. Dohan and seconded by Mr. Beuttell, the Commission voted 6-0 to ratify the enforcement order. Approve Minutes: 1/13/2020 and 1/27/2020 2 Minutes will be voted on at the following meeting. Site Visit Schedule for 2/24/2020 Meeting The Commission will not be conducting formal site visits for filings for the 2/24/20 meeting and instead will be walking the GCC proposed trail. 7:00 pm New Public Meetings/Hearings ViewPoint Cloud Permit 4CDOA-20-4 Request for Determination of Applicability, Adams Street Right of Way from Burlington Town Line to North Street intersection Applicant: Town of Burlington Project: Installation of water main Submitted Information: - MassDEP Determination of Applicability Application with associated attachments, prepared Town of Burlington Engineering Division - Plans, "Adams Street Water Main", prepared by the Town of Burlington, signed and stamped by Stephen J. Hildreth, PE455344, dated January 8, 2020 - Engineering Memorandum, "0 Adams St RDA Comments", to Karen Mullins, from Michael Sprague, dated February 6, 2020 Mr. Tom Hayes, Mr. Steve Hildreth, project engineers and Assistant Town Administrator, Mr. John Unesio, with the Town of Burlington presented before the Commission. The applicants are proposing to install a water main stretching from the Adams Street right of way in Burlington to the intersection at North Street in Lexington which is within the 100 foot buffer zone of a bordering vegetated wetland. All the work will be completed within the existing roadway. No new fill will be brought in. On a motion by Mr. Beuttell and seconded by Ms. Dohan, the Commission voted 6-0 to issue a negative determination with conditions. ViewPoint Cloud Permit 4CDOA-20-5 Request for Determination of Applicability, 33 Drummer Boy Way Applicant: Drummer Boy Homes Association Project: Installation of EV charging stations and associated activities Submitted Information: Chairman Phil Hamilton recused himself from the filing for 33 Drummer Boy Way. Mr. Bitsko was appointed as Chairperson for the hearing. Ms. Marsha Good presented before the Commission. The applicant is proposing to install electrical vehicle charging stations in the parking lot which is outside of the 100 foot buffer zone of a bordering vegetated wetland. They will be installing three concrete pads and a light pole. 3 Concerns of the Commission: • The applicant needs to submit a revised plan showing the light pole. • The Commission is not confirming any wetland delineation. Responses of the Applicant: • The applicant will submit the revised plan. On a motion by Mr. Beuttell and seconded by Ms. Dohan, the Commission voted 5-0 to issue a negative determination with conditions. Chairman Hamilton re joined the Commission. 7:11pm ViewPoint Cloud Permit 4CNOI-20-1 DEP 201-1171 Notice of Intent, 45 Fouler Avenue Applicant: Marina and Igor Balk Project: Raze and rebuild of a garage Submitted Information: - MassDEP Notice of Intent Application, prepared by Stamski and McNary, Inc., dated January 2, 2020 - Plans, "Wetland Permitting Plan", prepared by Stamski and McCary, Inc., signed and stamped by Joseph March, PLS and George D'Makarakos, PE, dated January 2, 2020 - Stormwater Narrative/Drainage Calculations, prepared by Stamski and McCary, Inc., dated January 2, 2020 Mr. Paul Kirchner, engineer with Stamski and McNary presented before the Commission. The applicant is proposing to demolish an existing single car garage and construct a two car garage within the 100 foot buffer zone of a bordering vegetated wetland and 200 foot riverfront area. The driveway will be expanded and cause an increase in impervious surface area. A drip edge is proposed along the east side of the garage. The applicant is going before the Zoning Board of Appeals to get approval for the front yard setback. Concerns of the Commission: • The test pit locations have been conducted on an adjacent lot considerable distance from the proposed garage and several years ago.. Can the applicant conduct test pits on the property at large in order to understand at what elevation the seasonal high ground water is? • The applicant is encroaching onto the Town of Arlington's land. Permanent markers and signage should be installed to show the property line which indicates where the abutting conservation area begins. The markers and signage will be added to the Order of Conditions as a condition. • Will any trees have to be removed? Is anything proposed to replace the vegetation? • The engineering calculations need to be revised because they inaccurately take into account pre- and post-development conditions. 4 Responses of the Applicant: • The applicant will conduct additional test pits. • The applicant will be removing a Japanese maple tree as well as shrubs. A planting plan will be submitted. • The engineering calculations will be revised. On a motion by Ms. Samuels and seconded by Mr. Beuttell, the Commission voted 6-0 to continue the hearing until February 24, 2020 at the applicant's request. Mr. Olsen, the project wetland scientist conducted additional tests and revised the wetland delineation accordingly, which expands the wetland delineation further into the property. The applicant presented their informal plans for the proposed building but will be coming before the Commission in the future with a Notice of Intent for the structures. On a motion by Mr. Beuttell and seconded by Ms. Dohan, the Commission voted 6-0 to continue the hearing until February 24, 2020 at the applicant's request while they wait to obtain a DEP filing number. ViewPoint Cloud Permit 4AOOC-20-1 DEP 1042 Amendment to Order of Conditions, 7 Crosby Road 5 Hastings School Applicant: Ameresco, Inc. o/b/o Town of Lexington Project: Installation of solar carport On a motion by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 6-0 to continue the hearing until February 24, 2020 at the applicant's request. DEP 1154 BL 1109 ViewPoint Cloud 4CNOI-19-16 NOI, 4 Tidd Circle Applicant: Maliha Karim Project: Landscaping and construction of a retaining wall at a single family dwelling On a motion by Mr. Beuttell and seconded by Ms. Ladd, the Commission voted 6-0 to continue the hearing until March 9, 2020 at the applicant's request. ViewPoint Cloud Permit 4CNOI-19-32 DEP 201-1170 NOI, 72 Kendall Road Applicant: Denny Zheng Project: Addition to a single family dwelling Submitted Information: - Revised Plan, "Site Plan for 72 Kendall Road", prepared by Hardy+Man Design Group, PC, dated January 31, 2020 Mr. Lane Goldberg, attorney and Mr. Chi Man, engineer presented before the Commission. The applicant has revised the wetland delineation and the project plans. The wetland has been delineated to be significantly closer to the existing dwelling. The applicant has scaled back from prosing two addition to only expanding vertically over the existing dwelling footprint. There will be no excavation. There may be an additional footing constructed in the basement of the dwelling. There will be no increase in impervious surface area. There will be no expansion of the driveway. Six signs notating the conservation and protected resource areas will be installed. Concerns of the Commission: 6 • In the past the Commission has been reluctant to allow continued mowing of wetland that is treated as lawn area but since the revised wetland delineation has shortened the lawn area they are willing to allow future mowing. • The Commission would like an isolated infestation of oriental Bittersweet (Celastrus orbiculatus) removed from the North side of the dwelling within the managed yard area of the property. Responses of the Applicant: • The applicant agreed to the proposed conditions. On a motion by Ms. Dohan and seconded by Mr. Beuttell, the Commission voted 6-0 to close the hearing. 8:02pm DEP 201-1137 BL 1094 NOI, 127 North Street Applicant: Ying Chen and Katherine Van Stry o/b/o Bull Realty, LLC Project: Raze and rebuild of a single family dwelling Submitted Information: - Revised Stormwater Management Report/Engineering Drainage Calculations, prepared by Gala Simon Associates, Inc., date revised January 21, 2020 - Revised Plans, "Drainage/Grading Plan Existing and Proposed Conditions", prepared by Gala Simon Associates, January 18, 2020 - Engineering Memorandum, "127 North St NOI Engineering Comments 3", to Michael Sprague, to Karen Mullins, dated January 24, 2020 - Retaining Wall Plan Details, "Retaining Wall for Driveway", dated February 11, 2020 Mr. Rich Kirby, wetland scientists from LEC Environmental and Mr. Al Gala, project engineer presented before the Commission. The project has now been approved by the Zoning Board of Appeals. The dwelling is now closer to the delineated wetlands and is proposed to be a smaller size. The driveway has decreased in size and will be comprised of pervious pavers. Concerns of the Commission: • At the point of contact from the porous asphalt to the segmental retaining wall, should there be additional drainage functions installed to help keep the water circulating? • Will any additional trees proposed to be removed? Responses of the Applicant: • The applicant can install a poly sheet and detailing to ensure successful drainage. • Only the originally proposed five trees are to be removed. On a motion by Ms. Dohan and seconded by Mr. Beutell, the Commission voted 6-0 to close the hearing. 7 On a motion by Ms. Dohan and seconded by Ms. Ladd, the Commission voted 6-0 to adjourn the meeting. 8:15pm
