Minutes of the Lexinqton Zoninq Board of Appeals <br /> Selectmen's Meeting Room <br /> January 9, 2020 <br /> Board Members: Chair— Ralph D. Clifford, Jeanne K. Krieger, David G. Barnert <br /> Alternate Sitting: William Kennedy <br /> Administrative Staff: Jennifer Gingras, Zoning Administrator and Sharon Coffey, <br /> Administrative Clerk <br /> Address: 95-97 Bedford Street <br /> The petitioner is requesting a SPECIAL PERMIT in accordance with the Zoning By-Law <br /> (Chapter 135 of the Code of Lexington) sections 135-9.4 and 135-8.2.1 to allow reconstruction <br /> of a non-conforming two-family dwelling in the RS (One-Family Dwelling) Zoning District. <br /> The petitioner submitted the following information with the application: Nature and Justification, <br /> plot plan, and floor plans. Also received at the Hearing on January 9, 2020 was a document <br /> showing dimensions of rooms. <br /> Prior to the meeting, the petitions and supporting data were reviewed by the Building <br /> Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Planning <br /> Director, the Historic District Commission Clerk, Historical Commission, Economic <br /> Development, and the Zoning Administrator. Comments were received from the Zoning <br /> Administrator. <br /> Presenter: Joe Marino, Homes Development Corp. and Fredrick Gilgun, Attorney <br /> The Hearing was re-opened at 7:19 PM. <br /> Mr. Fredrick Gilgun presented the petition. He stated at the first Hearing the Board questioned <br /> what would be proposed would be more sustainably detrimental to the neighborhood. The <br /> applicant produced architectural plans. A hand out was submitted showing dimensions of <br /> rooms. He then explained the units. He reminded the Board that the new structure will eliminate <br /> an existing encroachment. It will not be substantially more detrimental to the neighborhood. The <br /> architect designed the structure for the site and location. <br /> Chair, Ralph D. Clifford, stated if approved whatever is built has to be in substantial compliance <br /> with the plans submitted. If there are changes that will need to be worked out with the building <br /> department. Minor changes can be approved by the building department and major plans may <br /> have to come back to the Board for a modification. There will be a great deal of uncertainty and <br /> the staff will make that decision. <br /> A Board Member, Nyles N. Barnert, asked if the site plan is where it is going to be (Mr. Marino <br /> responded yes). <br />
