<br /> <br /> <br />Selectmen’s Meeting <br />May 25, 2019 <br />An emergency meeting of the Lexington Board of Selectmen was called to order at 9:32 a.m. on <br />Saturday, May 25, 2019 in the in the Selectmen’s Meeting Room of the Town Office Building. <br />Mr. Lucente, Chair; Mr. Pato; Ms. Barry and Mr. Sandeen were present. Ms. Hai and Ms. Axtell, <br />Assistant Town Manager participated remotely via conference call. <br />Board of Selectmen Alcoholic Beverage License Regulation Applicable to Package Stores - <br />Memorial Day Hours of Operation <br />Mr. Lucente explained the Town was contacted by one of Package Store Liquor License holders <br />about being open on Memorial Day. After reviewing the Selectmen's Alcoholic Beverage License <br />Regulation Applicable to Package Stores, Memorial Day was included as one of the days in which <br />Package Store Liquor License holders are required to be closed. This Selectmen’s Regulation was <br />adopted in 2004 and last revised in 2010. Mr. Lucente further explained that in 2016, MGL Ch. <br />138, Section 33 was amended to allow for off-premise licensees to be open starting at noon on <br />Memorial Day. The Selectmen's policy has not been revisited since the change in State law. <br /> <br />Upon a motion duly made and seconded, by roll call the Board of Selectmen voted 5-0 to <br />approve, in accordance with MGL Chapter 138 Section 33 regarding the hours during which sale <br />of alcoholic beverages for off-site consumption (under MGL Chapter 138, Section 15) may be <br />made by any licensee on Monday, May 27, 2019 to be from 12:00 Noon until 10 PM. and further, <br />to issue a waiver under the provisions in the Board of Selectmen Regulations for Alcoholic Beverage <br />License Applicable to package stores under Paragraph 2, Section 3 for Monday, May 27, 2019 from <br />12::00 noon until 10:00 p.m. <br />Adjourn <br />Upon motion duly made and seconded, the Board of Selection voted 5-0 to adjourn at 9:39 a.m. <br />A true record; Attest: <br />Suzie Barry <br /> <br />
