12A Command Authority, Succession and Protocol <br />Policy & Procedure Page 4 of 4 <br />• Lieutenants, by seniority in rank; <br />• Sergeant, Shift Patrol Supervisor; <br />• Sergeants, by seniority in rank; <br />• Detectives, by order of seniority within the bureau; <br />• Patrolmen, by order of seniority unless otherwise designated by the <br />Patrol Supervisor or Commanding Officer. <br />3. If a temporary assignment, such as an overtime shift, places an officer <br />in two protocol positions, his command authority shall be <br />commensurate with the highest-ranking position. <br />4. An officer of lesser rank may be in charge of a specialized function, due <br />to specialized expertise or training. In this case he/she will still consult <br />with the highest ranking officer on scene. [12.1.2(b)] <br />D. All employees [12.1.3] <br />1. All employees will obey any lawful order of a superior, including any <br />order relayed from a superior by an employee of the same or lesser <br />rank. <br />2. If an employee receives an unlawful order, the responsibility for refusal <br />to obey such order shall rest with the employee to whom the order was <br />given. The employee shall be strictly required to justify such action. <br />3. If an employee is issued a conflicting order, which conflicts with any <br />previous Department order, it shall be the responsibility of the employee <br />to call attention to such conflict. If the superior issuing the order does <br />not change such order, the employee will not be held responsible for <br />disobedience of previous orders. It should later be reported to the Chief <br />of Police in writing for clarification.
