that WHEREAS the Lexington Water Company, a corporation duly established
at Lexington, Middlesex County, Massachusetts under powers conferred
upon it by certain acts of the Legislature of Massachusetts, being Chapter
267 of the Acts of 1881, and Chapter 349 of the Acts of the 1892 has taken
the waters of Vine Brook and the springs of tributary thereto, and certain
lands with the rights, easements and appurtenances to the same belonging,
and being the property of Katharine L. Lawrence, situated in said Lexington
and particularly described in the instrument signed by said Lexington
Water Company, dated September 13, A. D. 1894 and recorded with Middlesex
South District Deeds, Book 2304, Page 491, and shown on the plan therein
referred to which is recorded with said deeds, in Book of Plans No. 87 ; and
WHEREAS, said Town of Lexington has purchased all the rights and
property of the Lexington Water Company and has assumed the settlement of
my claim for damages against said company sustained by me by said taking
or otherwise : and
Whereas my said claim has been settled by the said Town of Lexington :
NOW THEREFORE, I the said Katharine L. Lawrence in consideration
thereof, and of three hundred and fifty dollars to me paid by said Town
of Lexington, the receipt of which is hereby acknowledged, do hereby grant
bargain, sell and convey unto the said Town of Lexington a certain parcel
of land bounded and described as follows:-
Beginning on Middle Street, near where Vine Brook crosses the same
at land formerly of Levi C. Teele, thence the boundary line runs northwesterly
by land formerly of said Teele one hundred and nine and 6/10
(109.6) feet more or less, thence deflecting 1° 30' to the left ninety and
65/100 (90.65) feet by land formerly of said Teele, thence deflecting 32° 0'
to the right ninety one and 66/100 (91.66) feet by land formerly of said
Teele to an oak tree, thence deflecting 7° 53' to the left one hundred
and sixteen (116) feet more or less by land of grantor, thence deflecting
166° 0' to the left four hundred and five (405) feet more or less to said
Middle Street by land formerly of Joseph Middleby, thence easterly by
said Middle Street, one hundred sixty six and 65/100 (166.65) feet more
or less to the point of beginning. Comprising 56/100 of an acre more
or less and being the second parcel described in said instrument of
taking.
Together with all the water rights in and to the springs and
streams connected with the springs and streams therein.
AND FOR THE CONSIDERATION AFORESAID I hereby release said Lexington
Water Company and said Town of Lexington from all claims for damages or
otherwise which I have against said company to this date.
TO HAVE AND TO HOLD the granted premises, with all the privileges
and appurtenances thereto belonging to the said Town of Lexington and its
successors and assigns to its and their use and behoof forever.
And I hereby for myself and my heirs, executors and administrators
COVENANT with the grantee and its successors and assigns that the granted
premises are free from all incumbrances made by me, and that I will and
my heirs, executors and administrators shall WARRANT AND DEFEND the
same to the grantee and its successors and assigns forever against all
incumbrances made as aforesaid.
And for the consideration aforesaid I, Robert M. Lawrence,
husband of the said Katharine L. Lawrence do hereby assent hereto, and
release to the grantee and its successors and assigns all my right as
tenant, in curtesy, in the granted premises.
IN WITNESS WHERFOR, we the said Katharine L. Lawrene and Robert
M. Lawrene hereunto set our hands and seal this eighth
day of july in the year one thousand eight hundred and nine-six.

Then personally appeared the above
named Katharine L. Lawrence and acknowledged the foregoing instrument to
be her free act and deed before me, Elie Angers, Notary Public
in and for the Province of Quebec, residing in the parish of
St. Etienne de la Malbaie, in the county of Charlevoix, on the
eighth day of july one thousand and eight hundred and ninety six.
