Secretary, September 7, 1961 The Historic Districts Commission met at 13:00 P. P1. on Thursday, 7, 1961, in the Selectmen's Loom, 'Town Uffice Building. Hearing was hela at 8:00 P. 11. on the application of Jenney Manufacturing Co. for a certificate of appropriateness for the display of signs on or adjacent to the premises at 3 Depot Square, which is within the Battle Green District. The hearing was adjourned at 8:20 P. M. Jenney Manufacturing Co. was represented at the hearing by a Mr. Lindberg, who stated that the only sign for which the applicant desired a hearing was that appearing over the doorway and show windows appearing in the photograph submitted to the Commission with the letter from D. R Toss to the Commission dated April 14, 1961. m r. Lindberg explained th:.t the other sign (Jenney Gasoline) appearing in th-t photograph had been rsmoved. Mr. toss, the owner of the sign for which a certificate was sought, was present at the hearing and participated in all discussion. Discussion was had with both gentlemen as to the size of the sign in question, as to the colors and features of the lettering and back- ground, as to the materials of ',hick the sign and lettering are constructed, as to hours and seasons of the year during which the neon illumination is customarily turned on by Mr. .Ross, and as to the possibilities and possible effects of removing the neon illuminating features. Mr. toss stated that it was his intention, which was corroborated by Mr. Lindberg, to discontinue the sale of gasoline at the premises in question by the end of July, 1962. The Commission then took that matter under advisement. Later, after considerable discussion, motion was made and duly sec'.:nded that tie Commission determine that the continued display of the existing sign would not be appropriate within the meaning of the act establishing and defining the duties of the Commission, that the Commission determine that the failure to approve the application would not involve a substantial hardship to the applicant, that the Commission further determine that approval of the application could not be made without substantial detriment to or derogation from the purposes of the act, and that the application be denied. Further discussion was had as to the lack of any historical value to or significance of the sign in question or of the building to which it is attached, as to the general design, texture, material and color of the features of the sign, including the neon illumination, as to the rel::tion of those factors to similar factors of other buildings, structures and signs in the immediate surroundings, especially of the other buildings, structures and signs for which the Commission has already issued certificates of appropriateness in the Battle Green District and within view of the premises and sign location in question, and as to the statements .made by the applicantT5 representative and by the owner of the sign. Sept 1 9 6 1 The chairman read the notice of hearing and the applicant's two letters of application. Appearing in favor of the application were " Michael Iascone, and Mr. 'Tito Casciere, Architect. Mr. Casciere presented scale drawings of the proposed signs. Questions were asked by various ',embers of the commission. The hearing was adjourned at 8:40 P. 11. On motion made and duly seconded, it was unanimously VOTED to grant to Michael Iascone a certificate of appropriateness with respect to the erection of two signs on the building at 5 - 9 Muzzeybtreet for use in connection with the business conducted at 9A Muzzey;treet, which is within the Battle Green District. Hearing was held at 8 :40 P. A. on the application of .elorence 1 L. Bernier, d /b /a Heritage Handicrafts, for a certificate of appropriateness for the display of a sign on the premises at 8 Muzzey Street, which is within the Battle Green District. The chairman read the letter of application and the notice of hearing. Florence M. Bernier and Arthur G. Bernier appeared in favor of the application and presented the commission with a sketch of the proposed sign. Various questions were asked by the commission members. The hearing was adjourned 8:55 P. M• on motion made and duly seconded, it was unanimously VOTED, to grant to Florence M. Bernier and Arthur G. Bernier, d /b /a heritage Handicrafts, a certificate of appropriateness with respect to the erection of a new sign centered over the few first floor window on the right -hand side of the front of the building at 8 Muzzey Street. Hearing was held at 8:55 P. M. on the application of W.11iam U. Bernier, d /b /a Tiny Towne Inc., for a certificate of appropriateness for the display of a sign on the premises at 1841 Massachusetts Avenue, which is within the Battle Green District. The chairman read the notice of hearing. william U. Bernier appeared in his o °•'n behalf and submitted a sketch of the proposed sign to be located at 1851 Massachusetts Avenue. Questions were asked by various members of the commission. The hearing was adjourned at 9:05 P. M. It was moved that the petition of Tiny Towne Inc. be denied for the reason that it was not properly before the commission. On motion made and duly seconded, the Commission determined that it cannot legally act on the application for the reason that in accordance with the application itself the hearing was advertised as being one dealing with a proposed sign at 1841 Massachusetts Avenue, whereas at the hearing itself it was determined as natter of fact that the applic -tion was intended to relate to a sign proposed to be located at 1851 Massachusetts Avenue The chairman announced that application for certificates of appropriateness had been received from Lee F, 'Tarbox and Christine M. L. bmith.
