1 <br />D <br />C <br />PLANNING BOARD MEETING <br />March 1, 1976 <br />The meeting of the Lexington Planning Board was called to order at 7:30 p.m. <br />by the chairman, Dr. Clarke with members Brown, Costello, MacKenzie, planning <br />director Briggs and secretary Mrs. Snow present. Mr. Zabin joined the meeting <br />at 8:05 p.m. Also in attendance were Robert Bradley, D.A.C. and Laura Nichols. <br />Minutes of February 9, 1976, were approved as written. <br />Donald Sleeper, Esquire, and Emilio Spagnuola met with the Board at 7:35 p.m. <br />for discussion of progress with resolution of drainage problem regarding INGLESIDE <br />Ingleside Pond. Mr. Spagnuola's proposed plan was previously disapproved SUBDV. <br />on September 8, 1975. Revised plan was displayed showing redesign of <br />drain invert. Memorandum of understanding, outlining developer's plan <br />for drainage was distributed by Mr. Sleeper. Questions regarding legal <br />aspects of the proposal were discussed. Town Counsel will be asked for <br />opinion of implications of wording appearing in deeds of residents of the <br />subdivision regarding easement to the pond. Mr. Sleeper will prepare a <br />written opinion of his interpretation of the wording which will be referred <br />to Town Counsel with Planning Board request for advice. <br />Definitive plan for Minuteman Ridge II, submitted on February 20, 1976, MINUTEMAN <br />was reviewed. B/A permit for the Planned Unit Development was read in RIDGE II <br />part regarding provision of access to PUD open space, which had not been <br />designated on the plan submitted. The developer will be asked to show the <br />access on the plan in appropriate location, and to define the right-of-way <br />with asplit rail fence. <br />Preliminary plan for Kendall Gardens subdivision, submitted on February 25,KENDALL <br />was reviewed, and photogrammetric map of the area was examined. DiscussionGARDENS <br />was tabled pending receipt of Engr. Dept. comments on the plan. SUBDV. <br />Suggestion for revision of Article 95, condominium regulations, were ARTICLE 95 <br />considered. It was agreed that upgraded area requirements should be CONDOMINIUMS <br />included in the revision to be prepared by Dr. Clarke. Laura Nichols <br />reported on her estimate of 250 to 275 lots in Town large enough for <br />additional construction as permitted in this amendment. Robert Bradley, <br />D.A.C. will provide a report on advantages of the condominium concept. <br />"W" Article 94, concerning basement elevations, was discussed. It was ARTICLE 94 <br />agreed to eliminate area requirement of 4,000 s.f., but 4 ft. basement WETLANDS <br />elevation reference is to remain.
